My husband would like to adopt my son. My husband is the only father my son has ever know...since he was 2, my son calls him daddy. My son's biological father has never been involved and chooses not to be...although he has never surrendered his rights. He (bio father) pays child support now for my son and has been since he was born. My husband and I recently got married and now we both want him to adopt my son. What is the first step to take? Where do I go? How do I do this? Are there any websites that can help me?

It depends...if the biological father will sign over his rights with no problem, then you could technically do it yourself, with some assistance from a document prep company. They would assist you in getting the adequate documents, complete them then you would take them and file them at the court house.
If he won't willingly sign over the rights, then you'll need a lawyer. My sister went through the same thing, and I tell you, the second her lawyer told the bio father "you won't have to pay child support anymore" that guy signed over the rights faster then she could blink ! Money talks.... use it to your advantage. |

Take my advice and WAIT. My daughter was in the same position and wanted her new husband to adopt her child. The law in her State is that the adoptive parents had to be married for 2 years. Well, he did a tour of duty in Iraq and their two years was almost up. He came home from the base one night and said, "I want a divorce, I'm out of here," and just that fast it was all over. Now I'm trying to console a heartbroken little girl who doesn't understand why the man she called Daddy just up and walked away.
The biological father will have to surrender his rights as a parent which isn't likely. He is paying child support and reserves the right to visit his son although he hasn't exercised that right. You can approach him and see what his feelings are on the matter. He may be willing to surrender his rights to get out from under his obligation to pay child support. Sometimes adoption can be a mine field that has to be negotiated very deliberately and very carefully. I wish you all the best. |
