A question about adoption based on Brothers and Sisters?

Tonight, while the first mother was giving birth, the adoptive father was in the ER having a heart attack.

So, my question....when is the adoption finalized....it seemed like the minute the baby came out, it was done.

And could the adoption be canceled because the adoptive father was "healthy" but now has a heart attack?

The mother would have a revocation period, but this storyline has been quite flawed from the get go.

I would think that any period for reconsideration would come into play as well as the time it takes for the courts to finalize things.

Adoption finalization usually takes 6-12 months, but the time period for termination of parental rights varies by state.

In some states, there is no revocation period. I've never seen that show so I don't know where it's set, but the TPR being a done deal when it's signed could potentially be accurate depending on the location it's meant to portray.

However, TPR could only be done after the birth. So the mother's rights wouldn't be gone the moment the baby was born. She would need to actually sign following the delivery.

Whether the adoptive father's heart attack could affect the adoption really depends on the agency (if any) and the revocation period on the TPR, so it's hard to say. It's possible but not a given, especially if the adoptive mother still wanted to push ahead.

It doesn't sound like the show portrayed this very accurately, but I haven't watched it, so I can't be certain.

I think the only way it can be canceled is if the birth mother (their words on the show) changed her mind after having the baby or during the period before it is finalized. I think that they are purposely making the birth mom act cold and distant on the show only to bring her back and have her change her mind later. Or at least have the option to do that later. It was so unreal (at least not how i think of things happening I am not a first parent and never adopted a new born) The birth mom just seems so business like no emotion

The birth mother usually has around two or more days, depending on the state, that she can change her mind.
The adoptive family has the child as an adoption placement for six months before they sign the final papers. During that time, an adoption worker will come out on a regualar basis and make sure things are going well.
But if the mother has signed relinquishment papers, and her time to appeal is up, and the adoption doesn't work out, either because someone got sick, or whatever, the child would not then go back to the birth mother. She is no longer the mother, legally. The child would be placed with another adoptive family.

Idk, I just wanted to say, that I was pissed at how this ended up. I really thought Trish would change her mind. I can not get over how CALLOUS they painted her. Is that how they really think FM's are? Like they just walk away, and don't even care that they are leaving their child to grow up in a family that is so messed up? Kitty accepted a job, Robert is running for Governor, he had an MI, Nora told Trish all about the F'ed up crap that happened with William. I mean REALLY?????? WTF!?!?!?!?!

And Kitty was going to leave Robert when he was giving the speech instead of watching the delivery! But she sure as hell didn't care to take the baby, even though it was on false pretenses.

I LOVE B&S, but the way that they have presented adoption so far, (and even with Kevin being Elizabeth's Bio dad), it just REALLY urks me...
