A question with adopting my fiancees kids?

My fiancee and myself will be marrying in june. she has two kids that already call me daddy, but we were wondering, for me to adopt them, would we need their fathers consent, even though they are not listed on the birth certificate and have not paied a cent of child support?

You have to start the adoption papers at the court. If you havent talked to thier dad in years or dont regulary contact him then the court will make you put an ad in the paper in his last known town and he will have 90 days to respond. if he doesnt respond his rights are stripped and youre in the clear to go forward with the adoption. If he contacts and wants to be in their lives then he has that right and it will be a whole other deal with the court as in visitation and all that. The court will make you attempt contact in a way before the adoption can proceed |

Yes you need to tell the birth father's. I bet after this long they will sign over their rights but the children need to know anyway. Think hard on this because once you adopt the children even if you two don't work out you will still have to pay child support you won't be able to use the I'm not their natural father. You will be paying for 18 years. If it works out then great. But no matter the child needs and deceives to know who their true father's are. |

If he's not listed as "father" on the birth certificate then you don't have to have his consent. However, if they ask her 'do you know who the father is' and she says 'yes' then they are going to ask to speak with him so he can sever his rights. That, or they may ask for a dna test to prove he's the father..then sever rights. |

I am not sure but I would think that if he isn't listed on the birth certificate as their father he would have no rights. Contact an attorney to be sure. Good luck to you and your new family. Smiles! |
