Adopting a developmentally disabled child from his parents, what steps do I take?

I care for a 7 year old Autistic child, his parents recently informed me that they no longer want him in their home. They would like me to adopt him, his father said they would draw up a letter terminating their parental rights and have it notarized. This seems a bit too easy for me, is there some sort of court hearing or CPS check I have to pass before I can adopt this child???

My home is state certified and I've been working with people with disabilities for going on 10years. I have all the appropriate clearances (i.e. background check, finger print clearance, etc) I'm just wondering if I have to go to court to settle this issue

This breaks my heart into a billion little pieces. :-(

You would need to be approved, by a home study. They can't just notarize a letter and call it a day. You would all need to go through a lawyer.

For what it's worth, this is sad.

ETA: BAM! And THAT was why I wanted Sunny to answer. :-) And of course they're exhausted. The whole situation is sad.

You realize that there is 93% chance that this child will need to be institutionalized by the time he hits puberty without anti psychotic drugs? What people who have taken care of ill children do not understand is how very different it is to do it 24/7. Something to consider.

You don't say how severe this child is, but 75% can be fully recovered by treating them for the true cause of their "autism". My son was DXed when he was 3.5. He was a perfect child until 2 when he began to fall apart physically, emotionally, and cognitively. A boy who had 35 words and the sweetest disposition of all my 3 children now cried all the time and had terrible gastrointestinal issues, and became non-verbal. Strange for a "psychological" disorder to cause all these medical issues, isn't it? Over the past 2 years we have treated him with diet (he stopped producing the digestive enzymes to properly digest milk & gluten), vitamin & mineral supplementation, and heavy metal chelation. My once "disabled" child talks a blue streak, is his once lovely self AGAIN, and is HEALTHY. He no longer has "autism" aka heavy metal toxicity. Check out this comparison chart here:

I hope if you adopt him you will do your best to unpoison him and help him live the life he was originally given.

To the poster that said autism is an "inherited" disorder: You are sorely mistaken, and are hurting children by saying this. In 1982, 1 in 10, 000 children were dxed ASD, now it's 1 in 91. Polio was was 1 in 4,000 at it's height--an epidemic. There is NO SUCH thing as a GENETIC EPIDEMIC. Please, if you care at all about children, stop LYING. If I'd listen to people like you my child would be in a rubber room instead of at the begining of a beautiful life.

there is so, so much more to adopting. As the others have said, a notorized statement will mean nothing. You need a lawyer, plus an adoption home study as they will do their own background checks, and fingerprinting and many interviews. Plus a court to approve it all and terminate their rights. It'll be at least 2-3 court appearances. And many thousands of dollars.

Only a judge can order termination of parental rights and order an adoption. What the father purposed, is not legal. If the parents are serious, then you all need to contact a family law attorney and s/he can guide you thru the process

You MUST go through the courts. A notarized statement is meaningless. In addition, the court will give the child a representative so that the child's needs are considered. While I think a judge would be supportive of your desire to adopt the child, s/he may also require that the family have help from social services before adoption can be considered.

As to the other poster, you have NO idea what it is like to care for a severely handicapped child. I care for handicapped adults and it's tough. It can easily overwhelm you. Given that autism is inheritable, it is also possible that the parents have some aspects of it themselves and find themselves unable to cope.

Get an adoption lawyer asap. Lawyer will have the rights of the parents done away with and everything take care of so that you can become the parent and nothing will come back to hurt you later
