Adopting a foreign child?

i want to adopt somebody i know. im a citizen and he's an immigrant in the US. the main reason for this adoption is for him to get legal papers in the US. and that way he can go to colege in the future. i need help on the steps to take. thanks .. by the wway hes 17 years old.

I'm not sure, but I think that this is not possible.

If I remember correctly, the adoptee must be under 16 years old if he/she is to get derived US citizenship.

Also, before you adopt a child who is not a US citizen, you must file for, and receive permission to bring a child into this country before you adopt. The US government would never give approval in this case, especially since the kid is already in this country.

If you went ahead without this approval and adopted the child anyway, you would have to live together with the child OUTSIDE the country for 2 years before the US government would recognize the adoption.

Please consult a good immigration attorney in your area because there is a risk here. If the young man is in the country illegally, he will likely be deported upon receipt of application.

I think that is illegal. He can apply for a visa and come here to go to school on his own. He doesn't need you to adopt him for crying out loud.

well, first wouldn't his parents have to give him up for adoption???...then the process would take some time, and I think this person would be over 18 by the time it happened, and I don't think there's any mechanism for adopting an adult. I am not sure you even need legal papers to go to college. don't you just pay the fees for the classes and go? I've never taken a college course where they asked for identification. Most places you just register on-line and show up.

Why can't he go to a community college; they have open admissions, don't they? LJ is correct concerning the rules for foreign adoptions. However you seem to say that this 17-year-old is in the US illegally. You can't go through a court in the United States and do an adoption for an individual whose status is not that of a citizen or legal alien, so far as I know.

I have a family friend who adopted a 14 year old from Mexico so she could be a legal US citizen with the opportunity to go to college. They recieved legal permission from her birth mother and they stay in regular contact with her, which makes it a little different than some other adoption situations. The girl will be able to get a good career and have a choice as to whether she wants to stay here in the US or take her education and skills back to Mexico at some point.

I don't think it is possible at 17 years old to adopt. But you can set him up with a US citizen who fall in love and maybe marry if they want to. Otherwise how can he go to college if he is married... Maybe not a good idea.
