Adopting a friends baby in another state?
Find answers to your legal question.

Adopting a friends baby in another state?

Where do I start. She is a close family friend who can't take care of another baby. Lawyers are expensive are there any ways this adoption can take place without lawyers. Its really cut and dry she want to give the baby to me. Any suggestions on where to start?

If she is a close family friend, then you need to look out for her well-being as well as her rights in the adoption process. Even if you are attempting to bypass lawyers. (although I would hope you would rather try to help her change the temporary troubles that is making her consider relinquishment, instead of jumping towards to permanent solution of adoption.)

You have to go through the legal system to adopt the baby. If it really is as cut and dry as you say, it shouldn't cost you much. Just the time for the lawyer to do the paperwork.

If you agree to it and she agrees to it then it shouldn't be too much work. You HAVE to do it through the legal system, talk to a lawyer and they should be able to draw up the paperwork.

I don't think there is any way to do it with out lawyers. Also since she's in another state you'll need an interstate compact agreement that basically allows you to take the child from one state to the other. You will need an approved home study saying you are qualified to adopt a baby. Also there is follow up after the baby is placed with you to ensure the environment is good for the child. You need to pay for all of these services. Some agencies work on sliding scale based on income and charge only for the services you use. I'm not sure how adoption lawyers charge. Also you didn't mention the dad - you'll have to make sure his rights are legally terminated, and that also requires a lawyer. Of course it is easiest if he just signs the papers, but not sure of the situation.

whatever
Home study is needed and post placement visits. Atty is absolutely needed. Very low cost for you but not free....sorry...

Each state has different rules/laws on adoption. The adoption will take place in the state where you the adoptive family resides. There is something called innerstate compact that your attorney will know about. Also, you will need to ask the courts for a home-study, this takes time but can occur while the child is in your home "legally". Some states the mother can change her mind up to 6 months after the child is placed in your home. It depends on what state the child was born in...GET an attorney!
