Adoption? complecated story but just wondering...?

I'm pregnant but I was wondering if my partners name was on the birth certificate could he adopt the baby in a year or so? or isn't it possible if he's the father anyway?

If your partner is named on the birth certificate, he wouldn't NEED to adopt. He will have full parental rights just like you, and can take custody by agreement with you.

Assuming you are reporting accurately on the birth certificate and he is the biological father, he wouldn't need to adopt to claim his rights if the two of you willingly decide together that he will take custody.

It would also be possible for you to work out shared custody together. Assuming you two are amicable and can agree, the custody situation between the two of you is not complicated. It won't require an adoption, as you will both already be the legal parents.

The fathers name has to go on the birth certificate for medical puropses in the future. Your child needs accurate information.

If your partner is the father and you have put his name on the birth certificate there is no need for him to adopt, he is the childs parent.

What ever your trying to figure out I hope you understand just how important it is for your child to have accurate information on their birth documents. Take it from someone who didn't think it through and did it all wrong. I was fortunate enough to correct most of my mistakes.

If you partner is the father, then the child is his, and putting his name on the birth certificate is what makes the child his own. Unless for some reason he requests a paternity test and it's found the child isn't his, then he can adopt / or he won't be required to support the child by law.

Legally if your partner is not the biological father then he can not be put on the birth certificate. If there is a chance that he is the biological father then he would sign an acknowledgment of paternity and his name would be put on the birth certificate and be the legal father.
