I am a single man who wants to adopt a 16 year old girl who's father left when she was very young and has never came back. she lives with her mom. Is it possible for me to adopt this child as if she were a stepchild but without being married to her mother? The mother is all for it but doesn't know if it is possible.
*to make myself clear, it is not my intention to remove her from her mother, but to legally adopt her as my child, yes we would live in seperate homes as many children do when their bio parents split, I have already taken the father role and take care of her as well as pay her mother child support.
I love this girl as my own and I desperately want to make it legal.*

Honestly i don't know if you're eligible, but i don't think it's a very good idea to adopt such a girl that old. She's about to be an adult and you'd be a father for her for only about two years. On top of that, you wouldn't even be in the house.
I see that you really care about her, and that's awesome, but you could play the role you want in her life as a close mentor/friend to her. You'll never really be her dad, no matter how much you want it. And making it legal won't really change anything. But you can still have a dad-sized impact on her life over the next couple of years if you choose too.

Fist of all the father would have to terminate his rights and you would have to pay an attorney to represent you and plus this process could take up to a year by that time she will be 17yrs old. i dont feel it is the best thing to do. She already knows you love her because youve been their for her all this time. |

this sounds very risky, i doubt its allowed, people are too untrusting to believe a 16 year old girl is going to be safe with a single man, they leap to conclusions and you get what happened with micheal jackson >=( |

While the mother is "all for it" according to you, that doesn't make it necessary or important to the child. You can be a father figure for the girl without adopting her. I don't see any reason why you should be allowed to do this, especially if you are not living with her mother, or about to marry her mother. If her mother remarries another man (not you) then there will be a severe conflict created by your adoption.

Although laws change from state to state, in our state, this type of adoption would not be legal.
To make sure that you would be placed as legal guardian of this young woman, if something happened to her mom, the mom needs to make a will, and in that document, there needs to be a directive that she wishes to place you as the permanentguardian of the child, in the event of her death or in the event she became injured or ill to the point of not being able to take care of the child. In that document, she should state that she would like for you to be able to adopt this young lady.
It's great that you have a relationship with both the mom and the young girl to the point of wanting to adopt her. Keep up the fathering to this child. It takes a special person to provide for this child, especially since you aren't related. My fiance did this with his ex-wife's child, who he'd tried to adopt for years. When the young man turned 18, they tried adoption as an adult, but couldn't because of a little law about not being able to adopt a former step-child in our state.
It would be possible to marry the mom, do the step-parent adoption, and then get the marriage annulled, because of not "being together". Sometimes, a stepparent adoption will hold, even if the marriage doesn't. It was a possibility put before my fiance and his ex-wife to adopt "M", by the attorney. |

Go speak to a lawyer that specializes in cases such as yours. They can give you the info you need and what your rights are, etc etc. It depends on your state or provincial laws regarding adoption. But I believe that is your best source for your situation. |

It is my understanding that the bio father would either have to voluntarily terminate his rights or it would have to be done by a judge.
Once that happened, if the mother and daughter both agreed it would indeed be possible.
By the way, I think it's fantastic that you want to do this.

I might be possible only if the mother gives up her parental rights. What you can do is try for an open adoption with the mother.
I would consult with a social worker or lawyer. But, there is a way and I know you'll find it.
