Aunt adopting a baby?

my aunt (well second cousin but more like a aunt) is adopting a baby from a family member (i dont even know how josephine is related to us..i think she is a cousins cousins niece or something)

she will allow the josie to visit the baby once a month.

is she legally forced to do this?

i think it is great that she is willing to do this.josie first consulted with a family about the adoption and they told her that they can visit the baby but somehow she found out that their first adopted kid wasn't allowed to see their birth mom so she changed her mind and chose my aunt.

josie is 13 and doesnt want to be a mom.

the thing is, my aunt lives 5 hours away from them but comes up once a month to visit the family so thats why she said that josie can visit once a month.josie lives 1 hour away from us so it is difficult.

josie said she doesn't want anything to do with the baby and doesnt even want to visit him but i think she will once she sees them.

i get to be in the delivery room when he is born! i know shell change her mind about seeing him.

her mom is trailer trash dad is remarried wit ha family of his own so they dont have much money.my aunt invited her to come live with her but she declined.

Adopting a family member's child is much easier on the child then giving him or her away to strangers.

I do have a problem that they are already putting stipulations on a visitation schedule. Maybe you could tell Josephine she could have your aunt become legal guardian of the baby, so Josephine could still retain her rights?

No, they're not compelled by law to allow the birthmom to see the child. It is encouraged if the birthparent is not a negative model in the child's life, though - it allows them some connection to them that stranger adoptions don't have.
My husband and I are fostering two of my half-sister's daughters, and our social worker said that if we do end up adopting them, pending termination of her rights, they won't be encouraged to see her unless they explicitly request to, but generally it is encouraged in relative adoption or kinship care when possible and safe for the children.
It doesn't sound like Josie is any danger to the child, so it's great that she'll be part of its life.

Many adoptive parents adopt a child, and promise the 1st parents they can visit, and once they have the baby, they lock the doors. I personally think it should be a crime to do so. AP's like that give good ones like us bad names.

Your aunt is not legally obligated (in most states) to allow Josie to see the baby, however, morally, I think it's great that they are working together. I think it's healthier for the baby in the long run too. One day, I hope open adoptions are enforceable by paying huge fines or something. I think that any adoptive parent who adopts with the belief that the adoption is going to be open ought to have their name posted so they'll never be able to adopt again.

Jose is one smart kid to realize she is unable to raise a baby..your aunt is not forced to allow her to see the baby..but it is good for all of them..and your aunt is a very loving caring person to allow Josie to be a part of the babies life.
