Can I foster or adopt my nice?
Find answers to your legal question.

Can I foster or adopt my nice?

Hi, the social service want give my nice for adoption, the social worker say that she prefers live the baby (few days old) with a relative.
My sister-in-law mother can' t take the baby (she drinks a lot and change man as often as she changes shoes), her brother has 4 children and he doesn' t want another.

Do you think it' s possible for me to adopt or foster this child??
I has a 7 year old, I can be able to take care of this child (free time, work, money, house, every thing it' s good), the only think I' m worry about is that I am not a citizen yet (I' m legally resident and I living in the same State since May '98).
Please, help, I don' t want lose a niece.
Thanks for your answer.
Additional Details
Mother and child are still in the hospital (baby is 2 days old).

You can try.. the worse they are gonna tell you is no. Where is the child's mother?? The social worker should see that you may not be citizen but you are legal. I would call Social Services and ask the case worker, I would not want a relative placed into the system either.

I don't think that should matter, if you can provide a safe, loving home for the child you should be fine

I would think you could either foster or adopt the baby. I admire you for wanting to take care of it. If Social Services wants to keep it with family members and you can prove you are a legal resident then it should not be a problem. They may want you to take steps to become a citizen and make that a condition of permanent adoption, If you can provide a loving and stable home, then talk to SS. If they want a family member anyhow then it shouldn't be a problem. It just a matter of going thru the steps and proving you can provide for the baby. Congratulations on the new addition.

Social services normally WILL try to place with a birth family member first...even if you're not legal yet, if you can prove that you're making steps to correct this situation, which it sounds like you are, they will enter that into your homestudy.

Now, they may follow up with you from time to time about that, but I would think that what they would do is have you pass the homestudy, and then place her with you in what is called a kinship placement.

If her mother makes no steps to correct her behaviors or work her case plan...then you will be given the option to adopt her in the future.

If you have a good bond with her mother, then she shouldn't say she doesn't want you having her...which, believe it or not, they will take into consideration (social services).

I wish you the best, as well as your niece.

I think they will give the baby to you to either foster or adopt they just have to make sure you have a stable home. And if your going to be a citizen in 18 months its shouldn't be a problem. Good Luck!

make an appointment with social services and discuss it. I think it is possible if you are a legal resident, and you do plan to become a citizen. Make an appointment as soon as possible.

Reachable
You have to be an American citizen to adopt in the United States

Why arent you a citizen?
You can apply for United States citizenship after being a legal resident for 5 years. So you more than qualify if you have been here legally since 1998.
Take the naturalization class and become a citizen NOW. then legally adopt her.

Go for it. Best of luck to you. If you can afford to hire an attorney, let the attorney do all of the work.

Best wishes...
