Can a foster child (toddler) work?

Can a foster child (toddler) work?

Can a toddler who is in foster care do print/ad modeling, pageants, etc., if they expressed an interest? Or would they have to wait until they are adopted/old enough to legally consent? Thanks!

Let me clarify a bit. We aren't looking to do anything personally. We know a little girl who is in foster care who is 3 1/2. She wants to do pagents and has expressed an interest in being a model. We just wanted to know if she would need to wait, or if it is even a good idea to begin with. Thanks

I am assuming that TPR has not occurred? Correct?

Permission would have to be gotten from the bio-parents.....ie. all paperwork signed by the bio-parents.
This might be more harmful to the child depending on the current relationship with the bio-parents.

(When I was in foster care before TPR, they could not cut my hair ~ like if I wanted a mohawk, there needed to be bio-parents approval)

If TPR has occurred, the state has to sign and approve.

ETA:
I actually agree with Andraya ~ let a child be a child ~ as if the foster system is not enough to deal with, the "culture" of these pagents is more to deal with for a little one.

I think that any parent that puts their children in those pageants have a loose screw. Its right up there with parents that buy their teen daughter breast implants. Its for their self esteem?.

If a foster parent entered a child into a pageant, it could actually be endangering their life and placement. Unless a child is placed in an area of the state where no one knows them, then the parents, or grandparents or other abusive person to them could be in the audience.

I'd say a simple pageant at school or a little county fair in an area away from the first family would be fine, as long as the child understands that it's more of a play-time than a contest.

If they're tryin to make Jon Benet Ramsey all over again, then those parents shouldn't be allowed to foster. Pageants should be fun for kids and adults, not a job for either of them. Foster children shouldn't ever be paraded for the gratification of their foster parents, as any bio, adopted, or grand child of any person shouldn't be.

As others have said, they Foster Parents are not the child's guardian's the State is. The State I believe would be the one to decide. When we were fostering our son, he could not have his picture taken without the Agency's permission.

Now, my thoughts on pageants:

I don't see how a 3 !/2 year old can decide all on her own that she wants to model or be in a pageant. She had to have been coached by someone to say this. How does someone this age even know about pageants?

I know that when we fostered, we were told that the kids could not be photographed for publication or appear on TV. This was a blanket rule for all foster kids in the state. But, it might be possible if all parties of interest agree

- Their CPS (or other state) case/social worker
- Their biological parents (depending on the situation)
- Their CASA guardian
- Their state appointed attorney

If all of these people are willing to sign, and I mean actually sign a piece of paper, then it might be ok. However, I think that is unlikely.

Those sorts of decisions have to be made by legal guardians, and I don't think that foster parents are legal guardians...they are only fostering the child. I don't think they have the right to make that kind of decision for her.

That would probably be up to the state (as the legal guardian), with input from the caseworker, social worker, etc.

ETA: I think putting little kids in pageants is disgusting. I forgot to add my opinion earlier.
