Can he legally adopt my daughter?
Find answers to your legal question.

Can he legally adopt my daughter?

My daughter lives with her mother and her boyfriend. I was recently informed by a third party that they are getting married and he is going to adopt my daughter. I have parental rights and responsibilities for this child. I live 700 miles away, I call weekly, I visit as much as possible. My wife asked her how her boyfriend would be able to adopt my daughter, and she said she was going to say I abandoned her. How is it abandonment? I call regularly, I just saw her in February. Now, however, her mother won't answer my calls or return them. I think she's trying to prevent contact so she can say that I did abandon my daughter. She wants me to sign papers giving my rights up so her future husband can adopt my daughter...I refused. She said she would run an add in the newspaper, but doesn't she have to run it in newpapers where I live? They live in Vermont. Is it even possible for him to adopt her?

are you on your daughters birth certificate..? if not, get on it.. fast..

if she is using the abandoned her, then no she does not have to put ad in the paper where you live,, all she has to say is does not know where you are..

start documenting when and what time you call your daughter.. use phone records.. send your daughter letters but send them registered mail, so someone has to sign for the letter, and you will have a record that you send it and she got it..

what ever papers your ex sends you to sigh, DO NOT SIGN THEM..

No that is impossible unless you haven't been paying her child support and all that good stuff, however if I were you, I would start collecting all my reciepts of anything that has been done with your child and consult a lawyer or an attorney in case she's really serious about it.

IDK!!
did you keep the paper..... intent is everything. if she goes forward the courts need to know you were aware of their intentions and that you responded that you were not going to agree.

If you are paying child support, then that's your proof that you have not abandoned your daughter.
If you were not married, that might be a problem. You should have a paternity done.
You need to consult an attorney.
And you have a little time, I believe they have to be married a year before he can adopt.

Sign nothing, keep track of everything.

Did you no that you can go and get you daughter and take her to live with you and there's nothing they can do ! until it goes though the courts for a custody case witch you could win or at lest get half and half custody
and i'm quite sure that they need you're consent for her partner to adopt her..i would never let antone adopt my child.

make sure you keep a log of everything that you do for this child, write down times when you call, and also keep your phone records. i dont think that they can say you abandoned if you pay child support and there is a record of it. also i think maybe you should talk to a lawyer. if they do run an ad in the newspaper call the office and tell them your side of the story, everybody cant ignore you.

ONLY if you give up your parental rights
(that is what my biological dad did and my "adopted" Dad adopted me)

If you deal with domestic relations(child support) call them. But no, Because of Social Security of all things! If, God forbid, you would die, your child is entitled to your SS payment until she is 18, because of this...1.You must sign away all parental rights ONCE a prospective "adopter"(lack of better term) is next in line, waiting. Call Domestic relations, or call Child Protective Services. What your ex is doing"parental alienation" is very much a form of child abuse. And yes, keep records on everything.Sign nothing w/o a lawyer. Actually, I would advise you call a lawyer ASAP
