Can i adopt my fiance's son before we get married?
My fiance has a 3 year old child, we have been together for two years. She is pregnant now with our daughter, and is due in 2 months. The father of the 3 year old does not see him or pay child support, he honestly would be glad to sign his visitation (parental) rights over and give his consent. I love her son very much, I treat him as if he was my own. Would I be able to adopt him without us being married yet? isnt that second-parent adoption? can someone fill me in with some more information? I know the laws consist of the state. I live in NEW JERSEY. thanks. I have already made appointments with a couple lawyers..and my job has a group legal plan which will pay for uncontested or contested adoption. After the adoption I will have life insurance, a will, and an attorney. Honestly the adoption is the best thing, and I would do anything to adopt him.

Her ex would have to sign over rights... And keep in mind that many states require you to already be married before adopting. (and some places require that you 2 be married for a certain amount of time) first. |

Just wanted to add that you'll probably need references and home visits as well. My husband had lived with my daughter for 10 years and we were married 8 and the state of Ohio still was going to go through with all of that stuff. I've heard that some states require you to be married as well. How far off if your marriage? If it's something you are sure of, maybe you can get married right now and then have a regular celebration later when you are able to. Good luck! |
