Can my husband adopt my child?

The biological father of my 4 month old daughter made it very clear before she was born he wanted nothing to do with her. since then i've gotten married and my husband is as much a part of my daughters life as her real father should be and then some. I do not have her biological fathers name on the birth certificate and can not find the man to even talk about signing over his paternal rights so that my husband could adopt her. What do i need to do to get this done?

You will need an attorney to handle it for you. Since you cannot contact the father, a legal ad will have to be run in a newspaper and a certain amount of time will have to pass before the adoption can go forward uncontested. After that, if the bio dad does not respond or contest, then it should be fairly cut and dried.
Even though you do not have his name on the birth certificate, you do need to try and contact him. If you don't he can come back later and prove paternity and then challenge the adoption later. Each state varies regarding the state laws about this, but paternity is a big deal and needs to be dealt with properly. |

yes he can and the courts will track him down to sign over rights. if they are unable to find him then the will drop his rights for him and your husband will be able to adopt your daughter. |

Call an attorney. But from what I know you will have to put an ad in the paper to find the father.And he will have to sign over his rights so you husband can adopt her. They will probably do a paternity to prove whether he is the father or not too. |

since he is not on the birth certificate, you do not need his consent. just go down to your government center and ask them about this. |

yes he can. since his name isnt on the birth certificate, you are the legal parent and you weren't married. the non-costodail parent (the absent parent) is a$$ed out. tell your hubby i give him props for stepping up to the plate.

hes not on the birth certificate therefore its sorta like he doesn't exist. contact a lawyer that specialises in family adoption services to get help with this. I have a friend who does this but she lives in another state. |

i would say to go to a court system and the your husband get rights to the child if it were to be the biological father |
