Can my partner adopt my daughter?

i have been with my partner now for 3 years, he is a fantastic father to her, we had a son together and another on the way, and as he should, my partner treats my daughter as his own, he biological father was not put on the birth certificate, he was not around at the time, he has never had much contact with my daughter and nothing at all for nearly five years now. we want to adopt my daughter together as we belive among other reasons, it will give her the stability she craves( can't really go into details but her bio dad has caused her a lot of upset over the years).my daughter refers to my partner as dad and has been doing this for the past 2+ years me and my partner are not married, and live in scotland, does anyone know our rights up here, and do we have to find her bio dad before we can go ahead. she has contact with her parental grandparents through a letter twice a year. we are a very happy family as it is, and we want more out of this adoption than just a change of her name

we had a paternity test done when she was small to proove he was her father.
it is still the case that i will have to adopt her too, as otherwise she is my partners child not mine anymore, we are happy with this, her bio dad has never paid child maintenance, and the contact with the grand parents will not be stopped if we can adopt her, she has had the contact with them since she was small, and we belive that stopping contact with them will upset her unnessaceraly

You can adopt being married or not now, the social worker you are allocated traces the bio father, if she cant find him after trying numerous times it still goes to court, if hes had no contact or anything its all in your favour, you don't have to adopt your own child anymore either just the step parent which is much better, it took my husband just over a year to adopt our son and its lovely you dont think it will make the difference but it totally does, good luck and get in touch with your local council and they will put you through to adoptions xx

yes he can adopt her as long as the father is not on the BC and then he would have to get permission but as far as i know he can adopt your daughter.

if he is not on the birth certificate, then that makes it easier, but he could still try , by going to court and the only proof he can get is a DNA, makes a bit more difficult that you have correspondence with his family , i would go to the citizens advice bureau they are very helpful, i think you will find that you may have to adopt her as well (Silly one that ) don't know if it's changed, also you stand a better chance if you are married unless that's changed too, but the citizens advice well tell you all you need to know so it is worth paying them a visit ... good luck ... hope it all works out for you all...

Most people don't realize how permadent adoption is--you can divorce him if you want--she'll be stuck with him forever should it not work out.

since no father is listed on the birth certificate, your partner can go to the local courthouse and swear paternity on the child, that will add him to the birth certificate.

if you do an adoption with no father on the birth certificate, the county you do the adoption in will put it in the newspaper and if the real father sees it and says no then the adoption cannot go forward. if no one protests to it within 30 or 60 days(in forget which) then they will let him legally adopt the child
