Can you adopt a child that is already adopted?

My husband's cousins are being raised by his parents, and things are not working out. Between both of their health and the little girls behavior it is not a good situation. My husband and I have decided to look into having her come and live with us. What will be involved in this, and is it even possible. Will it be harder since we would not be taking her little brother as well. The girl is 12.

The girl wants to come with us, and her and the little boy do not get along at all (it is worse than just brother and sister fights) And it would not be as if they did not see each other on a regular basis

It would be the same as a child and his/her n/parents. Rights would have to be termianted.

The grandparents are the legal parents, not guardians.

Why not just do a guardianship and walk around the red tape....adoption does not have to happen in order for the child to come live with you.

Are the a/parents in agreement with the child coming to live with you?? That is the question...if they are then shouldn't be that hard to do.

ETA:

As for separating the siblings and the legalities?? There is nothing in adoption statute that I have ever heard of that mandates siblings must be kept together. Sibs are separated all the time, think about when a parent has a newborn and an older child but places the newborn for adoption....same scenario only in this case the door is not closed between the sibs and they will be able to have a relationship.

As long as the children can have a relationship and still know one another.....not an issue.

You should NOT take the girl if you cannot take the boy. It's highly doubtful the courts would let you do that anyway. How sad for those kids. If you think that girl has behavior problems now, wait and see what happens if they remove her from her home and her brother.

Well I don't think you should separate siblings...You say they fight, but I challenge you to find a brother and sister that are actually sweet and nice to each other...sibling rivalry is pretty common. Her behavorial issues may come from needing attention, missing her parents, or a number of other factors. Why don't you help them out by trying to get her into therapy?

So its a bad situation for the both of them due to the aging parents... but you only want to help the one child? I don't get it. They shouldn't be separated. It makes no sense why you would pull one child from a bad situation and leave the other one still in it. Legally you might have a chance, but ethically, you should either raise both or neither.

It is highly unlikely that you would be able to adopt this girl who has already been adopted. Also, highly unlikely that any judge would allow the siblings to be seperated.

It does not have to be done legally. Go to the courts with his parents and try to transfer guardianship
