Someone was asking me this and I did not know.
Say you give birth in a country that you are not living in and are not a citizen of, can you give your baby up for adoption in that country if the child is born there?
For example, a German lady gives birth in the USA - can she adopt her baby to an American couple? Additional Details EG The German lady is not living in the USA - she flys there solely to give birth.

Probably, i mean that would make the baby legally an American citizen wouldnt it? So, rightfully they could stay in there own country to be looked after by there own kind of people. |

The baby would be a citizen of the country he/she was born into, probably a dual citizen of his mothers country as well. So as an American citizen he could be adopted by Americans. Otherwise you have to go through a lot more red tape and both Embassy's. |

With the don't ask, laws in the US, any person could potentially give birth here and give it up for adoption, after all if you drop it off at a safe station, who will know it is not American? after all a newborn cannot speak. As for other countries, hard to say, if they have something similar, then you probably could get away with it. |

Yes you can. But the German Lady would also have documentation that she has given a child up for adoption. There's always a paper trail. |

If she is here on a resident visa, yes she can. If she is here on any other visa, it has to go through the German consulate (in your example). The consulate does not have to approve it and can insist that the mother and baby return to their home country.
I found this out when a college gal went to Norway and gave birth and tried to adopt out her baby in Norway (to prevent ex boyfriend from claiming him). He was notified by the US consulate and he went and claimed the baby. He lived in the apartment next door to me, but I was never nosy enough to ask further questions.
One of the exceptions to this is a signed surrogacy contract. For instance, a woman in England who is surrogate to a couple in CA or TX can come here, have the baby and no problems. However, in MN, that would not be upheld.
BTW, in many countries, the baby has the citizenship of his/her parents, regardless of where born, unless the parents have permanent residency in that country. I'm not certain, but I think that is even true of the US now. |

if you dump your baby in another country, there's no reason why they would deport it...
as for officially adopting it out, i would think you can. |

I believe there is a new law with the tough immigration standards now that states if parents do not have a permenent address in the states, then the child is not a citizen of the country.
As for adoption, she can take the baby to a Police station or Firehouse and leave it in the care of them no questions asked without risk of punishment. |

as long as they have an attorney on retainer who can handle all the paperwork BEFORE the German lady comes to the USA to give birth, i'm sure it would be possible. |
