Many international adoptions may have age limitations, but in the US, I'm not sure that there is one. I would suggest contacting a local reputable adoption agency to determine if age is a factor for the type of adoption you are interested in.

yes you can, but i dont think it is fair to the child, there is alot of age difference, younger mothers fit more in school and what is going on with there age. |

My wife and I are both in our early 40s and just adopted. Age was never brought up through the entire process. And, in the classes we took to get certified (as foster to adopt parents) most of the people were likewise 40ish. |

Definitely! Some countries do place an upper age limit on adoption, but that's usually 55+, not 40. You won't have any problems!
Now, many agencies or social workers will suggest you adopt a toddler or older child when you're 40+. But, they certainly won't stop you from adopting. |
