My husband came to the US when he divorced his ex wife back in Mexico. They had 5 children together. Shortly after she took the oldest who is 12 and moved from Mexico to Texas. She left the other 4 who are 11,8,7, and 5 back home with her mother. My husband sends more than enough money to support them but now that we have a home to bring them to we want to bring them here, and either have the mother give up her rights or have her rights taken from her for abandoning them and I want to adopt them as their legal mother, him still being their legal father and raise them together. Will they automatically become citizens if they are adopted by a native of the US?

No they will not.
I would suggest that you talk to his ex wife about this because its more than common for the men to come to the states for work and then slowly abandon the wives/families for a Gringa. They send a crappy 100 dollars a month to get by on back home for the care of the multiple children meanwhile they live separate and more prosperous lives.
If you want to throw abandonment into the picture look at what your husband did. He abandoned his family and the court systems in Mexico as well as Central American countries are aware of it. Its a major cause of divorces.
To be honest with you...don't be surprised to find out that he isn't even legally divorced from his first wife. |

No, they will not become citizens just because they are adopted by a US citizen. Children born in another country and adopted by American parents still need to go through the naturalization process to become US citizens.
This is the least of your problems. Gaining custody of any of the children will be more difficult and costly even it at all possible unless the mother signs up her rights to the children. |

They should already be citizens or eligible for citenship if their father, ur husband, is a U.S. citizen. Thats how it works. He just has to prove that those are his kids and do the paper work.
As for takin away the mothers rights because of abandonment would all depend on Mexico's laws.
I would suggest working with the mother about the rights, and letting her know the opportunity it will give her kids. |
