oK..A man falls in love with a woman, who is already pregnant. He's been intimate with her, but is not sure whether the baby is his and is also aware of the woman's previous relationship with another man. So, he decides to ADOPT the baby...This is in the state of FLORIDA. This man says that he is NOT married to the woman, but he did adopt the baby. Is that true or possible. By law, do these two people, "living together" and the woman is the biological mother of the baby, HAVE TO BE MARRIED? I need help understanding this situation..

If I understand correctly, Man #2 states he adopted the baby. In order for that to be true another man (Man #1) must have been recognized as the biological father. Man #1 would have had to willingly or unwillingly terminated his parental rights so the baby could be adopted by Man #2.

If Man #2 was legally recognized as the father at the time of the birth then there would have been no need for him to adopt his own child.

I haven't been able to find the exact Florida statute on stepparent adoption, but generally people must be married in order to adopt their partner's child.

Legally he cannot adopt the baby unless he is married to the mother. What he could do is to sign the birth certificate when the baby was born and be the legal father of the baby that way.

A man can sign the birth certificate (in the hospital) and be the legal father even if he knows he isn't the biological father.

He may have just claimed the baby as his on the BC. Unfortunately, people do it all the time... name someone else as the father.

first, to adopt, the mother would have to name who the father was to have his rights terminated. and if this guy thought there was a chance this was his then a paternity test would have been a heck of a lot cheaper and easier than adoption. And yes, for him to adopt they would have to have been married. A single person can adopt but one must be married to adopt a "partners" child. sounds like a phony story to me.

If he is on the birth cert then he is seen as the father as long as there is no test to prove otherwise. They do not need to be married for that to happen.

No law can disobey the will of the two people . If they both want to get married then they can , thats for sure

If the man 'adopted' the baby legally, then it would not be his. Therefore his girlfriend or whoever she was cheated on him. Nice lady, really.
Nobody HAS to be married. Ever.
