Does anyone know anything about adult adoption?
|
Okay, yeah this sounds weird. My step-mom wants to adopt me and my brother once his 18th birthday comes around. I know at that point we won't need our birth mother's consent (she wouldn't give it even though she makes no attempt to contact us). My question is: Can someone be adopted after they are married? Weird I know. Additional Details I'm not worried about inheriting anything from my birth mother except for my genes.

I adopted-back my son (who had been stolen for adoption when he was an infant) when he was 27 years old. Depends on where you live as to how state law deals with adult adoption (example: you can freely do it in California and NY, but not in Ohio unless the person being adopted is handicapped).
Adult adoption has been around ever since legal systems were invented (example: Roman emperor Caesar Augustus adopted the adult Tiberius to be his heir) and in fact is an older legal process than legal child adoption (invented in 1852).

Yes, you can be adopted at any age. If you are in the US (which I assume from your avatar), you need to check the specific requirements for your state, as adoption is under state jurisdiction, including adult adoption.
Most states have a required age difference between the person intending to adopt and the person intending to be adopted. For example, in Utah (where I live) the requirement is that the intended adoptee be at least 10 years younger than the intended adopting parent. Also in my state, if you are legally married, the adoption would require the consent of your spouse. This applies to both the adopting parent and the adoptee (your husband has to say/sign that he's okay with it).
In your case, the fact that you are talking about your stepmother (and you are already the legal daughter of your father) can only help you. There is a pre-existing relationship and the courts generally look upon such a situation favorably. This assumes that your stepmother and father are also legally married to one another (which I also assume).
I would suggest that you look up the laws in your state. I found mine by doing a google search like this: "Utah state law". The result I got was www.le.state.ut.us/~code/code.htm.
You can do the same for wherever you live. Best of luck to you! |

Yes, you can.
Many times, in the case of a step parent with adult step children, the step parent wants to make sure their step-children have inheritance rights. One of the better ways to do this is through adoption.
and no, after adulthood, no one needs the consent of their birth parents to be adopted by anyone, however, it may compromise your inheritance rights regarding your birth mother. An attorney can answer any questions you may have about that. |

Yes, a married adult can be adopted. I know of a case that happened in Louisiana. If they allow it there with the strange laws that they have, they'll allow it anywhere! |

yes, a married adult can be adopted.
you should do this only if you feel there is a parent-child bond with the stepmother. Some states hold that a parent and child bear some responsibilities toward each other, for example, an aged parent in need of care. If you were single, your parents would be considered next of kin and would be consulted about medical issues if you were injured and unable to speak for yourself. |
