Does anyone wonder if sealed birth records can be included in the new FOIA Mandate?

Since I heard of this yesterday and reading this..am wondering if sealed birth records could be part of this FOIA Mandate. What do you all think? Could this be a possibility? Am truly looking for others opinions.
"The Government should not keep information confidential merely because public officials might be embarrassed by disclosure, because errors and failures might be revealed, or because of speculative or abstract fears," Obama said in the FOIA memo, adding later that "In responding to requests under the FOIA, executive branch agencies (agencies) should act promptly and in a spirit of cooperation, recognizing that such agencies are servants of the public."

It's an inventive thought... but I don't think so. FOIA usually covers materials produced by the government about the activities of the government. Birth records are produced by the government, but about private individuals. It's going to take more than this, I'm afraid. |

FOIA is federal. Adoption records aren't. |

Good eye, Gypsy! We have to be creative in our thinking and creative in our outlook and this is. FOI may be INTENDED to be about Government records concerning government, but that doesn't mean that it cannot be used by us, at least until they see their error and make moves to correct. I would think that, unless we are specifically excluded in some other area, that this should work.
And, it doesn't matter if it is state or federal documents, they are all subject to the Freedom of Information, I believe. Someone should try it and see. What the Heck! The worst they can do is say "No". We have ALL been told that before. And, for the mothers, what are they going to do? They ahve already TAKEN our firstborns, so the worst has already happened! The can't kill us. |
