FIANCE WANTS TO ADOPT MY DAUGHTER?

My fiance has been in my daughters life since she was 8 months old & she is now 7. She doesn't know her biological father or that he even exists. He chose to move to the other side of the country when she was born & never tried to make contact at all. I tried but he insisted that she wasn't his..I can't say that I didn't try. My fiance & I have a 5 yr old together & are now expecting twins & we would really like for all the kids to have the same last name so obviouslly he would have to adopt her to make this happen. We just don't know how to go about this so any answers would be greatly appreciated!!

No, he doesn't have to adopt her for her last name to be changed to his. If you have sole custody, you can change her name.

Rules vary from place to place but in California, at least in my county in California, my niece's dad had to be married to her mother for A FULL YEAR before petitioning for adoption.

You have to either get her bio dad to sign papers giving up all rights or you have to have her declared abandoned by him before your fiance can adopt her.

I think you gotta get married first and then petition for a step parent adoption.

you need to go to court and get some paper signed by you saying its ok.i cant really remember the steps by my friend in high school had it done.good luck wish you the best

yea i would so do it!! He sounds like a great man. You are so lucky to have him. Good luck and congrats on the twins. My mom and step dad adopt kids and foster kids and some of them have my parents last name and some dont.

Contact a lawyer (family law) and let him know your fiance wants to adopt your daughter. He will petition the court for the adoption because the child was abandoned by her bio father and has been raised by your fiance. He will send a letter to his last known address(bio dad) requesting he appear in court to contest the adoption. If he is a no show the lawyer will run an add in the legal section of the news paper and set another court date. If he is a no show again the adoption will go through. You and your fiance may want to get married as soon as possible to show the judge that her adoptive father will be in her life permanently.
