Getting a baby out of foster care?


My sons in foster care hes 4 months old. Its temporary foster care. How do i go about getting him back,how do i apply? i do understand theres assessments i need to go through and thats ok, what kind of assessments are there like physcial, mental...etc. and how long do these usually take. please someone tell me.

his dad was hurting him...we live apart and have done since i was pregnant. i didnt know nothin about it until one night he hurt him 2 much and he went into hospital. ive odne nothin wrong and im cleared off all charges etc, ive bin told i can start applying as soon as ive been told how to. dont think im a bad parent, i just want my little boy back.

This sounds fishy to me and I absolutely feel for the baby..injured to the point of needing hospitalization. Grr.

First of all, when CPS takes a child, the bio-parents go to Family Court and are given a case plan they need to work. Elements of the plan include things like parenting classes, rehab, job training, etc.

All of this should have been told to you during family court. If you are truly clear of the abuse, once the worker investigates and makes sure the baby will be safe, you will get the child back. If there are problems, you will have to work your case plan. In general you have 15 months to do what the Family Court tells you. If you do it, you will get your child back. If you don't, they will terminate your rights.

We fostered a little boy who was also hurt by his "daddy" and got taken away from the mother as well. They did their investigation and found that "mom" had some issues and it took her a while to get her son back. The rule is 16 out of 22 months in foster care if you can't get it together by then - they have the right to terminate your rights as a parent.

Good luck! If you wanna do this - it can be done. Just make sure you do what your plan entails.

You need to ask your son's social worker about this, he/she will tell you what your next step should be. Every situation is different, so it would be difficult for anyone other then CPS to tell you what you need to do.

In Missouri, parents are given a plan telling them what to do to get their child(ren) back 72 hours after they are taken into care and every month after that. Have you not been given a plan? You need to do what they say. If they say "Jump", you say "How high?". That is how you get your kid back. It sounds crude, but I am being honest. I tried to help my kids first parents get their kids back, but they decided that the kids were better off with us. They would get mad at their plan and not do what CD asked. I didn't really understand that, because if CD took these kids away from me, I would stand on my head and piss in my pocket to get them back. You do whatever you have to and you will get him back.

Was he taken from you or from the other parent?

If he ws taken from you, you need to contact your case worker to find out what services they are requiring you to complete. you should have an attorney to help you through the court process

If you baby was taken from his other parent, you need to call Childrens Services (CPS) and find out who is the case worker. You then talk to him/her and find out what steps you need to take to gain custody of your child. This will include an assessment of your living conditions, job, and criminal history. You will most likely be appointed and attorney to help you

This should have been answered either at a hearing, court or by the social worker. You should have a "plan" to work on - it depends on your needs as to what migth be involved. You must prove you can / will provide a safe, nurturing home for this child before you get him back. Are you having visits? What did they say in court? Hmm...you should have all this info

You should be entitled to receive your son back, I am not sure how long these checks would take. But should be within a couple of months.

Someone from children's services should have already contacted you concerning the steps you will need to take to regain custody of your son. I would contact the children's services for your county and ask them for the caseworker in charge of your son's case. It seems as if they have already made some sort of contact with you if you know that you need to take some classes. If it's temporary custody, the case plan is probably to reunify with you. This is something you need to be discussing with children's services.

I have adopted 2 children through the foster care system.

You need to contact the Department of Children and Family Services and let them know who you are and how you are related to your child.

You DO have rights if you didn't abuse or neglect your child.

Ask them:
1. Who your child's caseworker is
2. How you can set up (supervised) weekly visits
3. When a court date is set up to determine the child's status

Above all else, be cooperative and DO NOT be hostile or give them any reason to consider you unfit.

They will investigate you and do a home study to make sure you are a fit parent. The fact that the baby was in a dangerous position with his father will likely reflect on you, since you did not protect him. If you truly want your son back, be willing for it to take months, maybe even a year or more. At this point the child is a ward of the state, and they should protect him above all else.

Sorry to hear about your troubles hun, but I really dont have a clue, I think the laws and rules and regulations vary from country to country....will say a prayer for you and your child tonight...hope it all works out for you .....take care..

who has custody? if you live apart i don't see why they took him from you! but, yea! i'd talk to a worker at cps as soon as possible, they are gonna be the ones to give your son back anyways!

Maybe it would help if you said why you lost him in the first place. Possibly, no one would want to give advice to help you get him out if you can't take care of him. Not judging, just stating the obvious.
