My sister & her fiance is wanting to sign over all her rights of her baby to me & my husband. She has her reasons & im happy to have the baby. Well my question is how do you go about giving your rights over to another? & what all do you go through? Please answer if ONLY you can help me with my questions.Thanks... And I do know that this is under adoption, I didn't know where else to put it.

When someone chooses another specific person to adopt a child it's called a private or identified adoption. You will need to talk to an attorney about the appropriate legal steps that need to be taken. If you don't know of any in the area you live in, call a few adoption agencies and ask who they recommend - they'll know the good ones. They can also give you details on the appropriate state laws that apply. I could tell you for Illinois but not Ohio unfortunately. Here, the biological parents sign forms called "Consents" that specify the family they want to adopt their children. The Consent also terminates their parental rights. The adopting family files a "Petition for Adoption" and the court requires a social investigation (basically the same as a home study) be done. Usually an agency is specified in the Petition to conduct the investigation. Here it takes 3-4 months to get this completed. The family and attorney can go to court 6 months after the Consents are signed and finalize the adoption with the judge.

first, there is no such thing as signing ones rights over to someone else. The best thing is to all go see a lawyer and they will get you through this. the bio parents will still have rights, but you would have custody. But if you adopt, the courts will terminate the parents rights and you could adopt. But this costs many thousands of dollars as you would need to have an adoption homestudy done and be approved by your state to adopt. |
