How can i adopt my girlfriend's daughter?

the biological father is not on the birth certificate and has no rights to her but what steps do i need to take so i can adopt her and where can i go to do that?

I'm not a huge fan of step parent adoption unless the biological father is dead... Truthfully.
So often teenagers come HERE and ask why they have to be adopted by Yet another Step Parent! It just seems like today so many Parents feel their child has to Marry Everyone They Do!
I never even thought of step parent adoption until reading it nearly 5 times a day here!
In general, I would say--get married and stay that way for about 7 years and then if it seems like the right thing to do--Ask the Daughter if she would like to be adopted.
~~~and Why didn't her mother know who the father was? I sure hope you don't end up being baby daddy for number 2! It's usually a good idea to Ask the Guy what his name is at least! Unless there were just too many anyway. |

Go to a family lawyer who can submit the proper paperwork, if this guy isn't on the birth certificate, and has not been in her life I don't even think there is any need to consult him. |

first, you marry her, silly, then you get a lawyer to file in court on behalf of the child....to first, terminate the other father's rights(doesnt matter if he isnt on the certificate....if they have no address to notify him, they will send it general mail to a post office, then print it in the paper-thereby giving him ample time to respond)...any hoo, the next step is the adoption part...the lawyer will have someone come to your home and do what is called a home visit from a person whom basically verifies the home is safe and vouches a statement for you guys....then after all that is turned in with background checks for you...you will finalize in court....go to a small town judge, much faster, and easier... |

Wow.
Why isn't the girl's father on her birth certificate? Unless he is dangerous or abusive in some way, that child has the right to know who her father is. You stepping in as her daddy doesn't erase her history OR her DNA.
The girl's father would have to give up his rights to her in order for you to adopt her. He DOES have rights to her, whether he's listed on the birth certificate or not.
Think about this: why didn't your gf list this man on her daughter's birth certificate? You know, if she did it once, she can do it again. How would YOU feel if she didn't list YOU as the father on YOUR child's birth certificate?
My advice is to steer clear. There's something fishy going on and I wouldn't want to be involved. |

It depends on which state you live in but even if he isn't on the birth certificate he will still have rights. Many states, such as NC, make you run a notice in the newspaper for a few weeks stating that he needs to come forward in a certain amount of time or else his rights will be forfeited. Really the first thing you need to do is get a lawyer because they will be necessary for this process and they will also know the local laws. Good luck.
ETA:If she still knows how to contact the father he may give up his rights voluntarily. It is pretty simple for him to do so. If you wish to go this route I would just suggest reminding him that if he does this he will no longer be responsible for child support. If he doesn't not only will he be stuck paying child support until the child is 18, but he will also owe child support for the months he hasn't paid. |

well, first you have to go and make sure that the father doesn't really want to be in the child's life and sign away his parental rights. then you can go to the court or get an attorney to do the paper work for you to legally adopt the child. |
