My husband and I have been married for 5 years now, I have a son that is 8 from a previous relationship. The biological father has not seen him since he was 8 months old, He has been paying his child support regularly but has not once taken his visitation rights. I know I will lose the child support but I am not a bit worried about it. My husband would like to adopt my son, What all do I need to do to start that? Do I contact the bio father first? should I go through any agency? or a lawyer? IDK I know our money is very slim but I have been having some health issues and I would hate for my son to go to a stranger (his bio father) if anything ever happened to me. If anyone has any websites I can look at or any advice at I would greatly appreciate it! Thanks you!

As far as I know, the father has to sign consent. He basically has to give the child up. You cannot do this without his consent. Would probably be a good idea to contact a lawyer who can set the papers up but at the end of the day the father has to sign. |

The father has to give up custody first.
I wonder, how much initiative have YOU taken to make sure visits take place between your son and his father? Are you sitting around waiting for him to make the call, or are you trying to facilitate meetings so your SON can benefit from knowing who his father is?
It would be a sad thing if your son lost out on his one and only father just because both his parents were too lazy to take his best interests at heart and do the right thing. |

You need to talk with his biological father, first.
You can't do anything, if he does not surrender his rights. |
