He can't be considered an orphan because you are his mother and you are still alive.
If your brother wants to adopt him he certainly can however he will either have to spend the money to do an international adoption from the US or he will have to fly back to India (and possibly put his immigration status at risk) and take the time to do an adoption through the Indian legal system.

If you sign over parental rights and set it up with a U.S. lawyer then they can adopt him as their own. He won't be an orphan. Have your brother contact a lawyer that specializes in family adoption cases. They will tell you what to do and what you'll need. |
