alright im 14 and my parents are abusive alcoholics and i dont no if im 2 young to be emancipated. If i am i have a person who wants to adopt me. So what does she have to do to gain custody of me if i cant be emancipated?? some one please help i need to get out of that house!!!

you will have to talk to a lawyer on this topic.... but I'll give you what i know.
emancipation.... first off you have to give good reason as to why your parents aren't fit to care for you.. then show the judge that you are able to care for yourself... meaning have a home lined up, go to school regularly and get good grades, and have a job so that you can pay rent and buy food for yourself.
As for adoption.... you have to get your parents' rights either terminated (by the courts) or have them sign over thier parental rights. This will be hard to do.. specially if the judge you have doesn't see that your parents are abusive.
Talk to a lawyer hun... that is your best option right now. |

Yes at 14 you are too young to be emancipated. In order to be emancipated you need to prove to a judge that you have a job & are able to support yourself fully.
You do still have other options though. You can live with the person willing to take you in, in an informal sort of way. Or if you tell a teacher, guidance counsellor, doctor or nurse they will refer you to other options such as child protection. |

The others are correct about emancipation, you're too young, and you must be supporting yourself financially.
For adoption, your parents must have their parental rights terminated. This can take time and you will need the help of Child Protective Services and a social worker.
Guardianship is another option a little less difficult to accomplish than an adoption. It doesn't totally severe the parental rights but gives the power to another adult to make decisions for you regarding your care. Given your age, this may be a good alternative.

Of course, it all depends on where you live, because laws vary from place to place. Contact your local Child Protective Services department and find out if you can go to live with this person while a social worker reviews the situation in your home. You should not stay in a situation with unstable parents who are abusing you.

ETA: Lawyers can be extremely helpful...the reason I didn't mention that at first is because I was thinking that because of your age, you wouldn't have money for that. But then I remembered that most places have some kind of free law service provided at no cost. Check into that in your area, see if you can get some help from a lawyer. |

Guardianship...is what I have done for one of my sons friends..it's a very simple process and it keeps the state out of the picture for the most part...unless the situation is that bad...be very cautious about the state...just because it says Child Protection Services...doesn't always mean you will be safe..and it doesn't always mean you will get placed in a home...they may not have a home open at that time...therefor you go to a group home...not saying foster care etc is all bad...but many kids have been abused while in the system....maybe the family willing to take you in can approach your parents with you..otherwise you may have no choice but to report your parents |

If your parents won't let her adopt or get guardianship over you, you can only be emancipated if you can prove you have a steady job to pay your bills and you are in school at least part-time. If your parents are that bad, get the system of welfare involved and have the woman who wants you go with you. Good Luck! |

Unless you can provide for yourself as in a house and food and things like that you will not be emancipated. You can however go to the Department of Children and Families and have them do the needed paperwork to get you out of your parents care. Make sure you inform them you are unable to return home and are affriad for your life. They should be able to get the placement forms for who ever to foster you until your parents right are terminated then whoever can adopt you. |
