Ok, My girlfriend just had a baby boy, but the biological father was not there for whole nine months, he is not here now. His name is not on the birth certificate or anything, I want to adopt this lil boy as my own. How would I go abotu doing this? As of right now the father does not have right or anthing, would we still have to take him to court or what? Please help

You will need an attorney or social worker to guide you both through this. Laws are different from state to state; if the father has been so uncaring, he will likely be more than happy to sign his parental rights over to you (inform him that this will free him of any obligation to pay child support; that should do the trick!). One of you should ask him first, and if he's agreeable, then you can all work together on it. Good luck! :) |

Even if the father isn't on the birth certificate, he is still the father. The mother knows that he is, and if she does anything without notifying him, she can get into big trouble.
What she should do is ask for him to terminate his rights legally, and if he says no, there is little you can do about it. He will have to pay support though, if he keeps his rights.
You will have to be married, possibly for a year or more, before you can adopt the child, even if everything else goes well. This isn't something to rush into. |

The biological father would have to terminate his parental rights before you could adopt the baby. |

I think you have to be married first. Don't do any thing rash.
I am not sure about the proceedings. Talk to a lawyer. |

just remember once you adopt a child, if you split with the mom, you are the legal father and YOU must then pay the child support until the kid is 18. you will have responsibilities also if you adopt the child. all the responsibilities of a father like supporting the kid regardless of your relationship with the mom. |

You really need to contact a lawyer that specializes in adoption. He already is yours, but to make it legal and do it right call a lawyer! |

As his father, he WILL have to sign over the rights of this child, then you could legally adopt him. But that is the fathers choice. If he doesn't sign over his rights he will have to pay child support, and sadly, because of this, he probably will sign the child over. Epically if he hasn't been around for the entire pregnancy and birth. But Just be SURE before you decide to do this, because you are dedicating your life to this child and to it's mother. Don't make him a fatherless child in other words. Make sure you Love the mom and she loves you and then decide.. because just adopting this child isn't the answer. |

The mother can ask if he want to sign over his rights
If he does not, and pay child support, there is nothing one can do
You can see a lawyer, but if the father does not want to sign his rights away, I do not think you can do anything |
