My fiance and I live in Ohio currently and we just bought a house together. My fiance wants to adopt my son and we have the permission of my son's biological father. Is it allowed? And what are the requirements for the adoption?

IM in Illinois. Im also going through an adoption procedure for my youngest son. My husband is adopting him. First off you will likely have to be married. Then your sons biological father would come in and sign over his rights so your fiance can adopt him. Its a very easy procedure when all parties cooperate. After he signs over his rights then its one day for maybe an hour in a court room, he signs the adoption papers and your done! (BTW you need a lawyer for this....for me its been about $600 total...and thats a really good rate I think)

I would wait till you are leagally married. It is allowed...but the biological father has to sign his rights away....which means he will have no say in anything that happens your sons life. |

The judge would still have to see a home study stating that the adoption is in the best interest of the child. and He'll still need to have BG checks and financial reviews. It's a life long decision and should be carefully considered |

wow, adoption is a really big step for any guy, laws change from state to state so you basically have to be married, his birth father also has to be prepared to give up all legal rights of him, you really have to also think that if you divorce he could go for full custordy of your baby |

I think it is great for your boyfriend to want to adopt your child. However, I would strongly recommend that you not do this until you guys are married. I do not think, a judge will grant the request of adoption unless it is a secure thing for the child. Living together is not looked at as being a safe, stable enviroment for the child. It might also depend on the age of your child.
