7 months into my pregnancy his father killed himself. When I had him I couldn't give him up. I tried but just couldn't do it. The prospective family paid my medical expenses and I wanted to pay them back. I was a college student at the time and could only afford $100 per month which was not good enough for them. They agency placed a judgement on my credit report without notifying me or allowing me to work out a plan. That was in August of 2002. How long will this stay on my report? I was told not to contact them further so I don't know how to fix this......

I'm not sure if you were told to not contact the family or the agency. I can see not contacting the family, but I can't imagine being told to not contact the agency.
You need to get an adoption lawyer to tell you if it's legal for the agency to "put a judgement" on your credit report. The laws may vary from state to state. So, go by the counself of a good adoption lawyer.

Do you have any kind of written contract specifying that you have to pay back any money for medical expenses during your pregnancy? It's my understanding that PAPs take a risk in pre-birth matching. I'm sure they were informed and are trying to screw you over. Find whatever paperwork you have and get a lawyer and sue to get whatever money you have paid them. |

I am pretty sure that collecting that money from you is completely illegal in the US, as you are fully within your rights to choose not to place, and paying medical expenses on a pre-birth match is a chosen risk on the PAPs part .
As for the credit report part, they couldn't have gotten a judgment without suing you and you not showing up for court. You should be able to get the judgment vacated pretty easily.

It can stay on your credit for 7 years. But the credit agency will sell it to some other collection agency and they will start calling. Do not offer to pay them anything so that they will not have another contract with you . Write the credit report system and tell them you dispute the claims. If the agency doesn't follow up it wii be dropped.
Second this is a first. Most prospective family stand back and let the tax payers pay for the child then show up. You should be able to get ss for your son since the father died. |

First of all, the agency is not allow to do that. And secondly, you shouldn't have to pay the family back. Unless papers were already signed saying you would give the baby up, then they have no right to be pissed.
Prospective parents should read up on the law and realize that if the women decides she wants to keep the baby the day before its born, she owes that family nothing- and the family shouldn't pay her anything during the pregnancy to begin with.
I would contact a state lawyer or something and talk to them about this. |

That sounds illegal to me. Did you sign some sort of loan payment? Maybe you should talk to a lawyer or legal aid. You don't have to pay anything back when you change your mind. |

Pull your credit report.
Type up letters for all 3 credit reporting agencies.
Type this word for word........
This is a "billing error", please remove it from my credit report immediately .
Under this sentence put the information of the company.
They will contact the agency and if they don't dispute it within 30, it will be removed. Most likely they won't dispute since its illegal. The Paps are SOL and all involved knew this from the beginning.
Make sure you put the exact agency/person/company information that is listed on each individual credit agencies.
Don't get into any details......its not necessary and it won't help.
Make sure you sign and date the letters.
Send them certified for record.
If they dispute it....then you'll need to get an attorney.
I would suggest suing them at this point. So they won't screw with you emotionally.
What will happen is that they will wait until the court date (to annoy you)and then call your attorney telling him that they will have the negative credit taken off your report if you drop the suit.
They are wasting your time and causing emotional stress. |

WHOLLY SH!T!!!! that is soooo illegal!
1) judgments remain for 10 years in most states...
2) get a copy of your credit report, and dispute the judgement. they have 30-45 days to validate the judgment or it will be removed. in other words, they have to provide a copy of a contract that you signed which stated that you will repay expenses if you change your mind. they will MOST LIKELY NOT DO THIS...BECAUSE IT'S ILLEGAL TO MAKE PREGNANT WOMEN SIGN SOMETHING LIKE THIS!!
3) after you deal with the credit report, call legal aid and SUE THE HELL OUT OF THE ADOPTION AGENCY! you did NOT owe them a damn dime. there is no law which states that you have to pay back money if you change your mind. how unethical.
hence why pre-birth matching should be abolished. they are doing this because you didn't breed and walk away.

I don’t know who you went through but technically you shouldn’t have to pay back anything. Now morally is certainly a different matter. This is why pre birth matching should not be done prospective adoptive parents should not have to a pay a pregnant womans medical bills (or any other costs) even more when its not a guarantee that they will get the baby in the end. There are even women who will scam PAP with no intention to ever give them the baby but they just want someone paying their medical bills and even other costs for several months. My Aunt and her husband spent at least 60grand on their son’s adoption had his natural mother changed her mind they just would have been out 60 grand as she would not have been required to pay it back. |

Usually, negative credit can remain for 7-10 years. If there is a Judgment the "creditor" can renew the judgment and continue to report the negative judgment.
Since it has been this long the debt is most likely being handled by a third party. Sometimes it is possible to negotiate with the collection company. They may settle for Half or accept the payments you can afford. |
