is it possible to give a child up for adoption to his grandparents and then adopt him back??? the reason we want to do this is because we are afraid to loose right to him altogether.

When you relinquish a child to adoption, you terminate your parental rights.
A better option would be for his grandparents to have legal guardianship.

Well, here's the thing... once you give the child up for adoption to his grandparents... the grandparents are in charge. They might decide that it's better not to allow you to adopt the child back, and because they would be the legal guardians, that puts them in the drivers seat. You would be at their mercy. |

If the grandparents qualify, then there should not be a problem but as someone else already pointed out, once you give up rights, even to a family member, its permanent until THEY decide to change things and therefore there are no guarantees. You may plan to do this now and if they change their minds or, God forbid, pass on and their will does not specify what arrangements are to be made for the children, you could find yourself out of luck as far as custody of the children is concerned.
Regardless, speak with a lawyer and ensure that both the children and you are protected. |

Yes its possible however the grandparents would have to agree to it since by legally adopting they become the child’s legal parents. If they did not want to give up their rights as the childs legal parents and let you re-adopt the child they would not have too. Adoption is not meant to be temporary care for a child. Why not look into having them be temporary guardians instead. |

You won't get him back unless they agree to it...but you can still be part of his life in a meaningful way.... |

I would call a lawyer to make sure. But, if you have a written agreement between you and your grandparents that state you would like custody at "such and such" point in your life. Then you have it in writing and depending on the laws where you are at it would be binding. I would really get a lawyer just to make sure you are covered and you don't sign papers that you can never take back. In some cases if you can not afford a lawyer..maybe a social worker can suggest one to you. |
