My Fiancee wants to adopt my daughter.?

My fiancee is in the Army. We have been together and known each other a great deal of time. Right now he is overseas [Iraq] and we are planning to get married once he gets home. He is helping me with my divorce from my daughter's dirt bag father. As soon as thats over he wants to begin the process of adopting my daughter. I have no problems with it, and her dad has NEVER been around so I doubt he will have anything to say. Does anyone know a good web site I can go to in order to look in to how to go about this? Or has anyone else done it and can give me some tips? I live in Texas right now, but when he comes back from overseas we are going to move to Florida. Thank You if you can Help. :)

I am in a similar situation and I have done a lot of research. I hope this helps. I am from Texas and my husband is currently working on adopting my daughter. I Texas you have to be married for at least 6 months. If you can afford to hire an adoption Lawyer, that would be the easiest thing to do, however, expect to spend about $5000. We are trying to do the adoption without a Lawyer.

First, you must have the Biological father sign and get notarized a voluntary relinquishment of parental rights form.

Second, you must file a ORIGINAL PETITION FOR TERMINATION
AND ADOPTION OF STEPCHILD form with the county clerk. In Texas, the filing fee is $292.00

You can search to try and download the paperwork on your own, or you can hire an online agency to draw up the paperwork for you, typically aroud $400.

You will be assigned a court date. At court, the judge will assign a caseworker to do a home study. The home study fee is typically around $600.

Even if the father is a real dirt bag, he still has legal rights as the birth father. The only way that your fiance can legally adopt his child is if he willing terminates his parental rights and agrees to the adoption. The other way, would be to file in court to have his rights terminated by the court system, but unless he is abusive or there is a legal reason for his rights to be terminated then it will be very difficult.

More than likely if he is a dirt bag, he will refuse to relinquish his rights just from spite. If he is behind on child support you could press charges for the back child support. Have them throw him in jail. Then he probably will sign away his rights.

If he is a good father to the child though, no matter what your feelings are toward him, then your child needs her real father. Tough dilemma to be in.

like the others have said, look up step parent adoptions. Most states require you to be married to your new husband for a year or two first though. But most important, you need the bio fathers permission. Next, your divorce is something you have to do yourself. There is nothing your fiancee cn do to help except maybe give you the money to do it. You could always ask your divorce lawyer some questions on the adoption.
