My Mom raised this girl without going tru legal adoption papers,im her only Son, who is the legal heir ,?

So i would like to know, who has more rights to inherit her state besides my Stepdad

Does your mother have a will? If so, that may outweigh anything else, depending on the laws in your area.

If not, you would be the only one in your generation with legal standing to inherit (though your stepfather would be in line to inherit before you.) Just raising someone without legally adopting them does not entitle them to estate benefits.

That said, I think you should consider what your mother would have wanted. If your mother raised this girl, she probably cared about her a lot. I can't imagine she'd want the girl left with nothing upon her death. I think you should consider giving her a share of the inheritance; even if you aren't legally obligated to, I think it would be morally right, for your mother's sake.

Don't be selfish split it 50/50. Why does it matter if it is going to your step dad. I think it is so crazy when families fight over someone elses belongings. Be respectful to your mom and divide fairly and peace fully.

Michelle

If there is no will then any estate goes to a surviving spouse, in most areas. After that it would go to children and if she isn't adopted then she would most likely be shut out. If there is a will though then it all goes to who ever your mother names, regardless.

As I understand things in most areas.

Legally her husband is the heir, then you; unless she has a will and then the estate will be distributed as she wished.

it depends on the will. if the girl is named, she gets it. if she is not named, she doesn't get it.

Depends on the state. Call an estate attorney.

well no matter what if she is married it will go to the spouse unless other wise stated in a will if she has it in a will that this girl gets it then it goes to her their is really nothing you can do to change it!

Yeah Yeah
she did'nt legally adopt her so legally she ISN'T her daughter so you do the math...

unless she does a will and she names her then that's a differnet story

Cool Hal
Its not about the money then!!!
