My husband adopting my children?

I have 3 children 2 of which are not my husbands. He wants to adopt them but we are not sure how to go about doing this... Now my oldest his father is on the birth certificate and my daughter he never signed hers as he was not around. My husband has been with us since my son was 4 and daughter was 3 there are now 8 and 7. He loves them like his own and wants to adopt but we are just wondering how to go about doing this. And if it will be costly. any help would be greatly appreciated. And please only serious answers. I don't care about ur opinions if there going to be rude comments...

The answer to this question depends on what state you live in. In most cases no contact by the birth father for over 2 years is considered abandonment and should make it very easy to adopt, you will probably have to post an add in the paper saying your looking for him for a month or 2 but that should be it. It should not cost very much (it cost us around $1000 for the lawyer and filing fees) and you can opt to fill out your own paperwork and file it yourself to save some on the legal fees. Basically, talk to a lawyer, most do free consults, just go in and talk to them about your options. Good luck

You need a lawyer. You may also need an investigator to find your children's biological fathers in order to secure their signature giving up their rights. Judges are getting savvy now that many men who would otherwise welcome being in their children's lives are told either that the pregnancy was aborted or miscarried or simply never told of the pregnancy at all. Thus, you have to prove that he had been told before you can seek 'abandonment' as a reason to have his rights stricken. Varies by state of course, but even in states that have registries, the adoption has been challenged because the 'average' guy is unable to find out where to register or even know that he can.

My husband adopted my son from a first marriage. First thing....go to a lawyer. Your children's birth father might not be willing to give up his parental rights however. My ex was more than happy to be off the hook on paying child support, so it was no more than having papers drawn up for him to sign. The daughter might be a lot easier since the father was never listed on the birth certificate. But still this needs a lawyer to look over the facts. Just remember that ex's can be a ***** if they want to be, so be prepared for just about anything.

I think for him to be able to adopt them you guys have to have the others parents consent or establish that the other parent can not be found or contacted but that being said they will do everything they can to have the other parent sign off on it first.

You need to have the fathers sign off on the kids. If he isn't paying child support or never has then it might be easier then you think. Talk to a lawyer usually the first time is free to talk to them they will have the answers you seek.

First find a family law lawyer. Explain the situation to him. He/she will answer all questions regarding the legal aspects. Its not very difficult and in NJ requires a court appearance, but its mostly as a formality. Good luck.

the father will have to sign off his rights to the kids which would not be a problem as he would be free of kid payments..

Go to www.adoptionattorneys.org and find a good adoption attorney. They will be able to walk you through the whole process.
