My mom legally relinquished me when I was 16, is my sister still considered...?

my little sisters kin.

Should anything happen to my mom, she would like my sister to live with me if her step dad couldn't do it. She says that because i am her sister wouldn't be a problem. But I was relinquished 11 years ago, so does that mean that my sister (different dads) isn't my legal sister?

ALSO, she assumes that my 2 sisters and I would automatically split her assets if my step father weren't around, but I would think that the other 2 are her only legal children. Not that it's that big of a deal, but if I am raising my sister, it would be nice to ensure that she could go to college and could fly home regularly to see her family. And I doubt she would have access to her funds before 18.

How do you think these issues would be handled?

Whether you are her legal sister should not matter. As long as your mother makes in her will that if her widow can not care for her then you are to take guardianship. As far as splitting asses well that would be up to your two sisters since you were legally given up your not entitled to any inheritances but certainly if they want to divide it with you that would be their decision. Unless your mother adds you to her will and leaves you something. After all people can leave things to anyone.

Your mother and Step father should really see an attorney about this and draw up some will or have this added in.

If your mom's not your legal mom, then your sister's not your legal sister and you are no longer her legal child.

So if anything happens to your mom, legally you have no kin connection to her or your sisters.

Legally you aren't her daughter and they aren't your sisters. If she wants you to inherit and also be the legal gaurdian of your sister then she has to put it in the will. She needs to see a lawyer. Get everything in writing.

You are not automatically entitled to your share of your mother's assets if she dies because legally you are no longer her child. Also, you are not automatically considered "next of kin" to your sister because, again, legally you no longer are.

However, all of this can be easily settled if she will just sit down with a lawyer and draw up a will. Since your little sister is a minor, she really needs to be protected by a will in any case.

I think that you should talk to a lawyer, it is in everyones best interest due to different things in different places. I admire what you are doing, I'm 12 years older than my little sister and I would like to think I'd do the same.
