My partner to adopt my 2 children?
Find answers to your legal question.

My partner to adopt my 2 children?

me and my partner have been disscussing him adopting my 2 children from 2 previous partners. neither ot the dads are on their birth certificates and have nothing to do with my children. my partner has been told for him to adopt my children i will also have to adopt my own children?? but that seems stupid to me.
Additional Details
apparently he was told by a nurse and a friend who is adopting his partners children. would i still need to get the childrens bio-fathers permission if they arent on the birth certificates?

Hi Carla, almost every answer on here is wrong, why do people answer questions when they havn't a clue what they are talking about!!

My husband is in the process of adopting my son and YES I have to adopt him aswell (this law is changing next year)

Here are the following steps you have to take.........

1) You MUST be married to your partner, ideally a year but its not set in stone, we were only married 3 months when we started the process

2) Contact your local High Court and ask to be put through to the Adoption Officer and ask them to send you out 'Step Parent Adoption Forms'

3) You MUST make every attempt to find the biological's as they need to give their consent, if you cant find them you need to show the courts that you went to the ends of the earth and back but still couldn't find them, your social worker will help you with this

4) Once the forms arrive out phone Social Services and explain what you are wanting to do, they will arrange for a social worker to call out who will help you fill out the forms, a cheque for £100 is needed for the courts aswell

5) The social worker will call out and see you every 4 weeks and get you to fill in Police Check forms

6) Your children will now belong to the courts and not to you, after the forms are sent off a 'Guardian' will be appointed from the courts as a voice for your children, he/she will also call out every 4 weeks to see your family

The adoption process should only take about 4/5 months but it might take longer in your case because of the biologicals

If the adoptions go through you will be on their new birth certificates as their adoptive mummy but as I said this law is changing sometime next year so you will most likely be adopting them after this as you aren't married yet

What is your rush? Considering your admitted history with men is less than stable you should reconsider.

Making your "partner" their daddy will not keep this one around. Think about the kids and what is best for them!!!

Was he told that by anybody in authority? I doubt it.

Talk to your local family placement services - they will be able to point you in the right direction.

40 weeks with #4 {anyday now}
you first have to be married for a year-
you don't have to adopt your own children, thats just silly, they are already legally yours. - i didn't have to.
you have to have NO CONTACT with the fathers for over a year, (contact can even be as petty as running into them at the grocery store, but not actually talking... and recieving child support is considered contact) or have their written consent

we're in the uk and looked into this recently.
Up until a cpl of years ago you did have to adopt as a cpl so you would in effect have to adopt your own child. This is no longer the case. You do need their biological fathers permission even if they have never seen him. Doesnt matter how long ago it was, you have to be seen to make every effort to contact him for permission. Also anyone over 18 living your home, including yourself and your partner need to have a CRB check done. Call your local social services department and they have information packs they send out.
Please be aware where we live (oxfordshire) it costs £140 per child.
Good luck

First of all, you and your partner will have to be married in order for him to adopt your kids. In some states, you will have had to be married for a certain amount of time. In some states, there isn't a time limit (I adopted my step daughter 5 months after I married her father).

Secondly I doubt you will have to adopt your own kids, you are already the custodial parent.

In most states, if there has been no contact from the absent parent the adoption can be done without their notification or consent.

You need to call a family law lawyer in your area and ask what the laws are in your state.

Good Luck.

I'll tell you what seems "stupid" to me.

You are not so good at the "partner" thing.

Instead of committing your two children, from two different men to your latest hunk, why not commit to him yourself? Do they still have marriage in the UK?

Why should THEY be ties to this dude for the REST OF THEIR LIVES when you refuse to do so.

I don't think you can adopt your own children but if you guys plan on staying together and getting married then I would go for it, but as far as you having to adopt them I never heard of that!!
