My question relates to adoption..my friend is adopted..but now her parents want to disown her..is it legal..?

hi..
my friend(Indian national) was adopted when she was just an year old..now when she is 19yrs..her parents who adopted her want to disown or nullify or reject the adoption...i want to know if they can do this legally..or can my friend file a case in the court for her mistreatment..is it possible under the indian law that her parents disown or nullify the adoption.. (hindu adoption law 1956)???please help she is very distressed...

Is she living in India? If she was adopted by Americans, and is living in America, then no. Adoptive parents can dissolution the adoption until the child is 18 in America. After that, the only thing that can be done is that your friend could choose to be adopted by someone else, which would nullify the first adoption. But her parents can't legally erase the adoption. If she is in India, however, I don't know what Indian adoption laws are, so I couldn't say.

Check out the following sections of the Hindu Adoptions and Maintenance Act 1956 in the link below:

Section 13: The parents may dispose of their property and wealth as they see fit (effectively disowning her from any inheritance if they wish)

Section 15: No adoption that was valid can be canceled at any time nore can the child renounce the adoption.

It looks like while the adoption can't be canceled or renounced, they can cut her off if they wish. As for any law suit for mistreatment, that would depend upon the nature of the mistreatment and not whether or not she simply didn't like how she was treated.

ANY parent (bio or not) can Disown their child! Disowning means that they will not get anything when the parents die and it is perfectly legal. The parents' resources are to do with what they wish! And NO there is no legal recourse for 'mistreatment' the parents' money and other assets are theirs to do with as they wish.

I'm sorry. She is legally an adult and the law cannot interfere with adult relationships as far as I know.

Perhaps she could trace her original family, it might help bring back some connection to her life again.

I'm not sure about the laws in India, but if your friend was adopted by US citizens then the parents are PERMANENTLY bound to that. There's no such thing as "I love you until ____," once you sign the paper and get them approved in a US court there is NO going back. Especially since she is over the age of 19. Now, the country of India may accept her being disowned, but the United States will NOT, nor will the US take away her citizenship. There are laws out there to protect immigrants of all types.

Your friend might be able to bring the issue of mistreatment up at family court, but many states have very strict deadlines for such things. Her best bet is to talk with the most local government agency that is in charge of foster care, they can give her the most relevant information on what things her adoptive parents can do and what her options are. The foster care people might seem like a strange place to go, but these are the people dealing with state adoptions and parental rights terminations, so they have more information than most.
