No singnature from Birthfather?

so in an adoption, if there is no signature from the birthfather, what could happen. if the birthmother does not get a signature or name the birthfather, what could happen?

If possible, the father's rights will be legally terminated by the courts. Many states have laws protecting a father's rights including something called "The Putative Fathers Registry". If the father does not sign the registry in the required time, his rights can be terminated and the child can be placed for adoption.

Happens all the time. It isn't right but it happens. The church adoption agency in my son's case had the natural mother sign a paper saying the father's name and one that didn't Oh course she used the one that didn't have the father's name so she could terminate her right before a judge. Now if the father does find out and signs the Putative Father's Registry with in the time limit. The good adoption agencies will back away. and so will the couple who want the child but believe me there are some that care nothing more than to get a child and then act like they did the world a favor.
You would also be surprised to find out that a lot of natural mother's use the I was raped or he rape me. My son's ex tried to use that one to. Or he knew about the baby and didn't support the mother or the child. Now there might be some men out there if they did rape they need to be in jail. I find the women that don't tell the fathers and don't make them a part of the adoption are doing a big mist justice to their child.

I think you have 6 mos. and if he doesn't come forward the baby can be adopted.

The birth father could come in the future and try and place a claim on the child. It doesn't make adoption impossible though. If the father never steps forward, usually no problems.

If he does, it means months in court and legal fees. The adoptive parents can still have a chance of keeping the child even if the birth father tries to claim the child. Usually the court can consider the child's best interest and adoption legal rights, and reasons why the birth father wants claim.

All states are different when it comes to adoption and birth fathers. Check your state laws on the subject.

The laws vary from state to state.

If the birthfather has abandoned the mother and not in the picture there are legal ways to relinquish his rights. In the same way that you may still get a divorce even if your spouse is MIA.

I am not sure what happens if the birth mother refuses to name the birth father. Check your state laws.

I know from experiance. My son was placed up for adoption. At the time i was going thru a divorce and the baby was not fathered by my ex. The state said bc i was still married my Baby's daddy was not allowed to sign the papers. He wasnt even allowed on the birthcertificate. yeah so if you have anymore questions email me.

The child cannot be placed. If an agency is corrupt enough to actually attempt giving the baby up, the father could take them to court and be given sole custody. The biological mother and the PAPs would have no right over the baby.
