My son is 6 years old, i was neevr married to his father and because of this and the fact he was born before december 1 2003 his father neevr gained parental rwesponsibility.
He is not a good father to my son, he doesnt see him, he doesnt call, not even a text, he wasnt there in october for his 6th birthday, no call, present, card...nothing. He's even running rings around the CSA so as not to pay
I have a gorgeous partner who My son and I lvoe more than anything, my son has asked him to be his daddy, he has accepted although he still calls him by his first name
What I'm wondering is, is there a way my partner can become responsible for my son legally, say soemthing happend to me, id like my partner to be the one who takes on my son. Can we get him parental responsibility to start with? then maybe continue onto him adopting my son. How does this all work, and does my sons biological father have to be informed even though he no longer wishes to have contact?! Additional Details I'm in the uk, his paternal grandparents still have very occasional contact. My son has a double barreld surname on the certificate, mine then his fathers. But that was dropped when he was very samll and so now although on the certificate not on any other document, he just has my surname.
To begin with I'd just like my partner to have a parental responsibility over my son. We'd like to leave it a bit longer, maybe if/wehn we get married, have more chilren, to then discuss with my son about adoption, i want my son to beable to fully understand it all. But a responsibility would be our priority first. Just to legally give him a right and say over what happens with him

ur partner can adopted ur son but his biological father has to agree, u could use the fact he wouldnt have to pay the csa if he gives up his rights. if he refuses u can go through the courts to fight, but it takes time and money and emotional stress. |

This happened to me when I was a kid. They had to go through a lawyer so he could adopt me. They didn't know how to get in touch with my father, so they had to run an ad in the paper in the most recent place where he lived. If he didn't respond in a certain amount of time, then the court took it as consent. He didn't, so they went through with it. Speak to a local lawyer - adoption laws are a little different from state to state. |

Don't get me wrong I'm not against this, it just makes me squirm a bit. a lawyer is a good idea but one who knows what happens to his paper work, (birth certificate) passport, inheritance, etc...
If your husband adopts him he will be an adoptee with all the wonderful stipulations that go along with being an adoptee. That's where the squirming part comes in. If you get like 40 copies of his original birth certificate, and there will be no passport issues for him down the line, or any other STUPID backlash that comes with being adopted, then I say go for it. He is old enough to understand for the most part and participate in the decision.
What about guardianship?
Okay I read this wrong I thought it said your son was 16, sorry, that's a bit different. what I said still stands except the part about him being old enough to understand and participate in the decision. His records will be sealed depending on where you live. Find a lawyer who is savvy in this area an explore the internet for situations that arise from not having an original birth certificate. Bone up on homeland security policy after 911 for the passport issues in case your lawyer doesn't know and anything else that might cause him a paper nightmare later on. |

Yes, he can adopt your son, However I believe depending on your state the real father must sign his rights away, with this would be any financial respon from the real father (which i am sure he would be okay with considering he sounds like a real ***) |

ok you can have your sons name changed to your partners as i did but if your sons dad is named on his birth certificate then he cannot adopt your son without your sons dads consent my son asked his father but he wouldnt hear of it so i couldnt go through with adoption but my son is now know as my husbands surname and i never have told his dad as he never sees him and because it was before 2003 |

yes I think all those things can be achieved, but you need to do them soon and legally. I would say contact a lawyer and set up an appt for a meeting to discuss what to do, and proper ways to do it. |
