Parental rights?

Can a mother (in MI) permanently sign over her parental rights to anyone (not a family member) without adoption proceedings? If so, can the guardian then apply for state help? I don't think it's that easy or it shouldn't be anyway.

No, she can't do it permanently. Every state has a limit even over temporary guardianships (i.e. parent is going out of the country on business). Unless you have a legal guardianship, signed by a judge, you can't apply for any state help as you do not have legal custody of the child.

It always has to be court documented when ever custody transfers hands otherwise it isn't legal. A mother can sign over rights but only through the courts and only if the courts agree it is in the best interest of the child.

a mother can sign over her rights but there is more legal action. child protective services would have to check out the adopters house and criminal recored to make sure that every thing is fine. the adopter will get full custody which means the mother will have NO right BUTTT if she decides to come back and say, "i want my child back".. you will have to go to court and she will have a right to have her child back as long as she is stable. the law protects the mother before anyone else.

ive just gone through this with my god daughter. her mother signed over all her rights at birth. didnt bother calling or seeing her daughter and then at 18 mos old, she pops up saying she wants her daughter. she wasnt even a stable mom and the judge gave her full custody and all my family has is visitation 4x a month. we're now back in court because my god daughter has become a mess since being in her mothers care.

Anything done has to be done legally, through the courts. Also, the father has rights, too.
