Permission for adoption?

Does your childs father (whom is not around and does not pay) need to give permission for your partner to adopt your child?

YES THEY HAVE TO PASS THEIR RIGHTS OVER TO THE NEW ADULT. IF THIS CHILDS FATHER IS NOT AROUND I'M SURE IT WON'T BE HARD FOR HIM TO PASS THOSE RIGHTS.

If he is listed on the birth certificate, then usually, he must give up his rights first. Laws do vary though, check with a lawyer.

And please retain a copy of the original birth certificate for your child in case he/she may want it someday. It is next to impossible to get it once it's sealed.

the original father must agree to terminate his rights and sign them over before your partner can legally adopt.

I'm not sure, just be very careful...a friend did this, her baby's father wasn't in their lives, and she got her baby adopted by her new guy, then they bust up, she met someone new...went through all the fuss of changing the baby's (now 5) name...it lasted a year and now they've split. I think it might be better just to keep the child's name to one...the first, and see where it goes. Surely there's no hurry, and it is an awful palaver to change everything on paper each time things don't work. Not wanting to appear too pessimistic, but hey, hoe...**** happens... :-/

Yes - if he is on the birth certificate, he has to sign away his rights as father in order for an adoption to be legal. Otherwise he can contest it and win later.

I would say yes. There are ways around it if you do not know his location.

Not permission, but he does have to relinquish or sign away his parental rights to the child. This will allow your husband to adopt him/her, and will also remove the biological father from the responsiblity of paying child support.
Your husband will not be able to adopt the child if he doesn't sign over his rights. Something to help persuade him is reminding him he will no longer be responsible for child support, and I do believe the state will not try to get back support from him either. Use it for your advantage !

There's a law, called the putative father registry, that in many states, if the father doesn't register, and if he doesn't provide for the child, and if he's not put himself on the child's birth certificate, he loses his parental rights. Ask your lawyer if your child can be adopted, based on this law.
