ok here is the deal. I am married to my husband. Yay we are so happy, however when I was 16 i got pregnant by my ex boyfriend who I was with for 5 yrs before we had a child. Either way I got pregnant and he didnt have nothing to do with the my daughter. He wasnt there for the birth so I didnt put him on the certificate. And I have no idea where he lives now. I have actually moved to a different state since then. My daughter is now 6 yrs old. She did see him once when she was 2 yrs old. So, here is the thing, we havent seen him since, but if my husband wanted to adopt her, what would we have to do since hes not on the birth certificate. and since he hasnt made any contact or paid anthing for the child? If anyone can give me answers, i would gladly appreciate it! Thankx

Since he hasn't claimed paternity or made any effort to be a part of the child's life, the process is fairly simple. You can go to your local DHR or child services and file the paper work for your husband to adopt her. Normally, your ex would have 30 days to contest the adoption but since he hasn't had any contact with her and has no legal connections, that won't happen. |

You can get a family attorney to handle the adoption. The lawyer will file notice in the area your ex lived at the time you were together in the paper and give your ex time to respond. After a year of now physical or financial contact it is considered abandonment in about 90% of the cases so then the rights are taken away and your husband (as long as you have been married for I believe it is 1 year) can adopt your daughter. I would contact the attorney and they can get stuff started for you. |

You would have to get legal advice. They will try and find the natural father and give him a chance to say if he wants it or not, but if he has had no contact or has not paid child support then he has no legal rights anymore. If he has been paying child support, he has rights and cn contest.
I would get some legal advice, most of these lawyers have free phone consults or free initial consults. I did a lot of research when my sister wanted me to adopt her son, but I ould not because the father said no because even though he was in prison, he was paying child support and he had rights though she had sole physical custody, so I would check into it. Find a lawyer...they will put something in the local paper to the last address you have for the dad and if no response then its VERY simple!
This should go quickly and smoothly seeing as the dad is NOT involved! |
