Shes probably getting her kid back?

So I know this 21 year old who lost her child about 16 months ago to foster care. The child is 2, just turned. Shes currently pregnant about 5 months along. She lost her job about 2 months ago,but now shes enrolled in school, she got caught failing a drug test for marijuana while pregnant 2 months ago...and they are giving her longer.

She was getting supervised visits in a building every week for 15 months and last month, they let him go to her house for the first time. Theres another court date in May...

are they going to let her have her son back in May or will it take longer?
Are they going to do anything about the new baby thats due in August?

(they have court dates every 3 months)

Each state/court system is different. Where I live, if a couple of months of overnight visits go well the child would be returned to the parent at the next court date. However if the home visits were just for a few hours, the next step would be overnight, then return to parent.

However, in my state, had she failed a drug test while pregnant, she would have either been sent to jail or residential rehab, and it would have set her case plan waaay back.

Honestly where I live after 1 year in care, her rights would have been terminated. (my state does way to many TRPs in my opinion)

However as for what is going to happen with this mother depends on the court system where she lives.

Doubt she will get the kid back in may and i bet they swipe the new one as soon as it is out and breathing.

I agree with others that a child DEFINITELY shouldn't be removed for one positive pot drug test. (I don't think marijuana should be illegal, but that's another quesiton LOL) However, this mother is trying to get her child back and keep the one she is expecting. So, it sounds like she knew she would be tested. So, it seems there is something more serious going on here that she needs to deal with, either more serious addiction, serious problems in judgment, or simple lack of commitment to her kids. I can't tell you what will happen, and I can't tell you what I think should happen without knowing the case more thoroughly. Sounds like you are rooting for her life to be going down the tubes so she looses her kids???

Too many variables to be sure.

The social worker, the CASA volunteer, the DA, the judge, etc all could influence the decision. If one or more of them feel she should not get custody, then she likely won't.

Also, the specifics of the case, how much she is keeping to the 'plan', her support system, etc. But, if she shows progress, even with the pot test, she very well might get them back.

So....she got caught failing a drug test for pot when she was three months pregnant correct? Isn't it hugely possible at the time she smoked she did not realize she was pregnant? A lot of people don't realize they are pregnant until the third month or so. Just sayin'.

They will probably try to take your, I mean her, child when it is born. In all likelihood it will be illegal and coercive but a womb wet infant is like crack to PAPs and kind of in high demand.

She may get him back then, she may not. It depends on how the visits and court date goes. I wish that she will get well so she can get her child back, have her new baby, and be a family again. She will probably have another drug test in may and that may affect the results as well.

Good luck to the 21 year old. She still has so much time to get her life back on track before the state takes the kid away forever. Being in school is a big plus to judges and CPS. Welfare is better than being homeless and being on welfare is no reason to take a kid away from someone.

She had a positive drug test at 3 months, you do realize that pot stays in your system for a month or sometimes more, right? Also, I didn't find out I was pregnant until I was 11 weeks, and yes, I smoked pot before I found out! It happens all the time.

Also, it was POT! big friggin deal!!!!!!! Uh oh, call in the troops, we have a wild one on our hands boys!

Come on, Have you ever tried it? It is no big deal, you can function like a normal person, and and it affects WAY LESS than alcohol does!

Also, it is a big debate in the scientific community right now over whether or not pot or tobacco is more harmful to the fetus. While I would NEVER condone someone knowingly doing either while pregnant, I don't see people running around like idiots saying that people should have their children taken away for smoking cigarettes while pregnant!

Also, good for her for going to school, she is obviously trying and wants to do something with her life. As for your question, most likely, they will do overnight visits first

I was 19, smoked pot, did acid and shrooms, ex, and getting dangerously close to a cocaine addiction. I found out I was pregnant, and guess what? I CHANGED! I knew that was not the kind of life I wanted raise a child in. I *stopped* using, and I dont do *ANY* drugs now, not even pot (I am not against it, I just choose not to) I have the occasional Long Island Iced Tea, and I take Zoloft (depression runs in my family), but outside of that,NOTHING!!!!! I am a GREAT mom to a happy healthy 18 month old son that is too smart for his own good. I FINISHED COLLEGE, and am waiting to take my state boards to get my nursing licence, so before you go looking down that ignorant nose, why don't you come bring your arrogant *** over to MY house and see just how WRONG you are!

I don't understand that. She is on drugs while pregnant, they should take that baby as soon as it's born and they will if she is tested positive during birth. or at least the state of pa. is that way. It will be up 2 the judge weather or not she gets the baby back. She will have a list of things she has 2 complete before she can have him back. Like drug and alcohol, parenting classes, home, transportation stuff like that.If she got visits at her home seems like they are planning on sending the child home. I have had 100's of foster children in the last 10 yrs...sounds like a lot of the cases i have seen...GL

God lets pray she does not get here child back and hopefully they take this one from her, she is putting both kids in jeopardy is she stupid, I swear there is so many people that wants to be parents and cant then there is people like her, what is wrong with this world, but as it looks they are going to keep on giving her chances hoping that she will change, but once a drug user she will always will be.
