My husband wants to adopt my daughter from a previous marriage. If I think that my ex husband will give up his rights, where so I start? Where to I get the forms? What is the best order to go about this. We are in Texas.

we want to do this without a lawyer if possible.

Unfortunately, you will have to have a lawyer. I live in Texas and a good friend of mine is going through the same thing. In order for your ex to sign off on his rights he has to have his own private attorney.

Actually, my mother adopted me without an attorney.
Call your local Surrogate's Office (just google your county and surrogate's office and it will give you the phone number) and ask them to send you the forms/fees you will need. You may even be able to download them off of the web.
You and your husband will probably have to go through child abuse/background checks. Your ex husband may have to fill out forms or you may have to just take out an ad in his local newpaper notifying him of the adoption (if he has no problem with it - he would just ignore it).
You will have a hearing date - the hearing itself takes all of 10 minutes.

You will need a lawyer. I adopted my wife's 3 kids from a previous marriage, and found the process complicated. Get a lawyer and do it right. |

I'm in Texas and here's the advice: Save up money and hire an attorney. Know that the attorney that you hire can prepare the Waiver, etc. for your ex-husband to sign so that he will not have to hire a separate attorney. |
