I had my son in 2002, his biological father is on birth certificate but we were never married and never lived together. Bio father has not seen my son since 2003. I have been in a new relationship since 2003 and married since 2007 and have another child with husband. My son has my husband's surname as we changed it through deed poll and didn't need bio fathers permission and his passport is in husbands name too. I am seriously lacking in info of adoption in Scotland and really just want to know what i need to do to ensure my children have same legal rights with regards inheritance etc. The bio father has no legal rights at present the way the law stands in Scotland, thanks for any help and advice!!!

Please be wary of any advice you receive here, Scotland's legal system is very different to the rest of the UK.
I would see a solicitor, without a legally binding adoption by your husband, I don't think your eldest son is entitled to very much if anything. |

As long as his name has been legally changed and there is no paperwork saying his bio father still has rights then he's legally entitled to your husbands asetts (or whatever inheritance he and your other son split). |
