my friend has custody of a newborn baby. the mother is incarcerated and asked that my friend take care of him. the father is my friends brother he also incarcerated. she wants to adopt him but she has little or no money..how can i help her find legal help?

Custody is not the same as adoption. Does the mother really want to surrender her baby? A woman incarcerated for a crime should not have to pay for her crime via a life-sentence of banishment from the life of her baby, with the associated long-term emotional pain that can comes from that. It is sad when incarcerated mothers are forced to surrender their babies and not given the opportunity to nurture and bond with their newborns. Jail systems that punish incarcerated mothers, as opposed to offering mother-and-babe units, are extremely cruel to mothers.
Instead of permanently taking that baby away from his/her parents, can your friend act as legal guardian until one of the parent's is released? |

1: She cannot adopt the baby unless both parents sign over their rights.Their rights are not automatically severed if they are both incarcerated.
2:Your friend will need to go through the adoption process (legal help/home study etc)
3:If your friend cannot afford it, why on earth does she want to adopt?
4:I would tell your friend that she needs some kind of notarized permission to take care of this baby.Is this baby even receiving health care? Vaccines? what if there was an emergancy?
Babies are expensive.Children are expensive.Teenagers are expensive. |

She should only adopt the child if both parents agree. Otherwise she should understand that she is just babysitting. Just because someone is incarcerated it doesn't mean they are a bad parent/don't want their children/a second class citizen.

I just got consent forms from my attorney on my son's adoption. If they'd like to fill in the words, contact me, and I'll fax them to you, or e-mail them. Then, she'll have to file at the courthouse, which she'd be better off paying for, and they'll have to have the forms notarized, which almost any attorney will be a notary, or the prison warden. Good luck. |
