My oldest daughter's biological father has never been in the picture. He left when i was 4 months pregnant. My ex/best friend took over responsibility after he left. We didn't date while i was pregnant but shortly after she was born we moved in together. She has my maiden name and it kills me that she does not have the same last name as myself and the only father she knows. The one who has supported her and stayed up all those sleepless nights when she was a baby. I have a good communication with her real father but he has never seen her. We (myself, husband, and bio father) have all agreed to a possible adoption. My husband would love it and so would I. She doesn't know that he is not her real father. She is only 7 and i am going to tell her one day. We live in tx anyone know how to even start the process of a step parent adoption.

First the biological father needs to sign over his parental rights to the child. Once he does that you simply need to complete the adoption forms and file them at the courthouse.
Once they're filed a court date will be scheduled where you, your husband and your daughter will need to attend. The adoption will be finalized (they usually make a big deal about it, giving the child a stuffed animal and a picture of you all)
Then you can change her last name on all the documents, and a new birth certificate with your husbands last name on it will be sent to you. |

i live in Canada and i know the process here is if the bio father wants nothing to do with the said child , the bio father gives up his parental rights and signs them over to the mother , the stepfather then goes through the process of either adopting her and goes through the courts, the SF then goes through the process of stating the reasons for the adoption. After that he should be her legal parent, Look for a lawyer who deals with family law, tell them your husband wants to adopt your daughter and become a full parent to her and the bio father wants to give up his rights. be careful thou cause you may also be able to call the family law courts in your area and ask them about doing it yourself and it could be cheaper in the long run..GL |

This is really a great story I'm glad that you found a man to love you and your daughter as his own! You should contact a lawyer and I am fairly certain that if the bio father is willing to just sign over rights that there is no need for home study or the cost out for an adoption. You should just be out court costs and filing fees. |
