had my baby since birth not biologically mine was ask to raise it frm the parents but have no paper work making me the legal parent though ive been taking care of the child for years with min support how do i legally become the mom

You will need to contact an attorney first of all.
The most ideal thing would be to obtain Legal Guardianship which will grant you the legal rights and responsibility of a parent--without the change of Identity or amendment of the original birth certificate.
Or
You could seek out a physical custody agreement with the parent(s) which may also include child support orders for the parent(s).
Or
If the parent(s) are not interested in maintaining parental rights you may approach them and see if they are willing to voluntarily make a private adoption agreement with you. There would need to be legal paperwork ending the parental rights and then legal paperwork to petition the courts for an adoption.
Or
If the parent(s) are Unfit and Unable to parent and Unwilling to make an agreement for legal guardianship or voluntary adoption you would need to take the legal steps to have their parental rights terminated against their will. In many cases, this would lead to some period of time where the parent(s) were given a case plan to follow in order to have their child returned and/or be proved unfit by the courts.
The ideal way would be to try and get permanent guardianship and have this legally done. There is really not way around a lawyer and a court being involved when it comes to the best interest of a child and who the legal parent is. |

You need to contact a lawyer. Are you still in contact with the parents? If they are willing to sign over their rights to you, and you've been raising the child for years and are a respectable, employed person I have trouble seeing how this would be a very complicated legal matter.
You should do it, if you are raising the kid. It could potentially complicate things if you are not the child's legal guardian in the future. |
